The House Foreign Affairs Committee has urged the government to stick to the memorandum of understanding, signed in 2001 between Thailand and Cambodia and known as “MoU 44”, as the basis for the forthcoming border talks to settle overlapping areas between the two countries.

 

The committee chairman, Noppadon Patama, repudiated a news report that former prime minister Thaksin Shinawatra had discussed the overlapping areas with former Cambodian prime minister Hun Sen during their recent encounter at Thaksin’s home.

 

Today, the committee invited representatives of the Energy Ministry, the National Security Council, the Army Survey Department, the Foreign Ministry and PTT Exploration Public Company to a discussion on the overlapping areas in the Gulf of Thailand.

In  fact Thailand is born from Cambodia.. The Khmer were the first that ruled over the peninsula...So no claims can be made by Thailand in fact

Can see why these two ex PMs, as it was their governments that produced MOU 44, wanted to discuss the overlapping claims, as lots for future revenue is at stake. These two former leaders maybe are still really pulling the strings behind both governments.

 

MOU 44 was signed in 2001, and has not moved forward much such, but the initial different boundary claims were made in 1972 (Cambodia) and 1973 (Thailand).

 

It seems that  both MOU 44 and MOU 43, before it, did not go through the parliamentary approval process but were issued under the authoritarian powers of both the governments.

 

Many have since claimed that MOU 44 has little legal standing and is unconstitutional. It may also go against the rule of law and contradicts the Convention of 1904 and the Treaty of 1907.

 

The actual overlapping claim area is a 27,000 sq kms and estimates have suggested the area potentially contains up to 11 trillion cubic feet of natural gas as well as large quantities of condensate and oil.
