Not necessarily so - and not being treated as such at the moment.

The attacker will claim to have mental health problems.  The courts will accept that and send him to hospital where, because he's in hospital and not prison, he will still be eligible for all his benefits.  After a couple of years, when the fuss has quietened down,  they'll claim he's cured and free him.

Exactly, always that old chestnut, mental health issues.
