Working in 2 jobs

Hi everyone!

 

I have a day job and I got a work permit under a BOI company.

 

On top of that, I am also a shareholder in another company (tourism industry) at 24% 

 

The tourism company has an office but it’s not a walk-in, meaning customers don’t come to the office and we don’t handle cash

 

If from time to time id like to work from that office, am I legally required to apply for a work permit under that company as well?

 

as per my understanding, it is not possible to have 2 work permits at the same time, on top of that i am a shareholder in that company and not an employee, and lastly we dont handle cash or meet customers in person, everything is done online.

 

What does the law say about that? I’m worried in case I work from that office and immigration visit, don’t want to have any trouble with them.

Does your work permit got any location written in it?

You wouldn't be working 2 jobs but doing the same job in another location.

As far as I know you can have two jobs in one work permit. But like you said yourself, you are not employed by that 2nd company.

 

Just don't think too much...

It doesn’t say location, but only company name and type of work

As far as I know you can have two jobs in one work permit. But like you said yourself, you are not employed by that 2nd company.

I generally agree with you, I know it’s unlikely for the immigration to visit an office, I just want to make sure I don’t break any law really

I think the important part is have a story ready for the unlikely case that someone checks you.

If you have a work permit for A and not for B then officially only work for A, never for B.

If you are a shareholder for B then I guess you should be allowed to check the accounting details from B. Just make sure you have them somewhere nearby in case someone ask you what you are doing.

Got one myself, used to have a location on it as now it hasn't, you can do the work at any location as long as it is for the same employer as on the permit.

Shareholders don't check accounting details, they read a statement that has been given by an accountant. So stay away from the accounts and just do your work for company A.

Having the accounts nearby is not a good advice.

yes, but as a shareholder I am allowed to be in the office 

 

the question is am I allowed to work part time as long as it’s not a Thai only job, I do not meet customers and don’t handle cash 

 

The reason I don’t issue a work permit is because I already have one under a different company (my day job) and you can’t have 2 work permits at the same time 

 

I think I’ll just consult an immigration lawyer because I can’t find enough details online

Are you being paid a salary with the tourism company or are you simply receiving dividend payouts?

 

It would be hard to see how a work permit could be issued without a salary given the minimum salary requirements.

You can add a second employer on your work permit if the current employer agrees.

An immigration lawyer won't do you any good as this is labour law. But if you just sit there doing your job for the first employer, you should be ok.

There's no problem with getting my day job employer to agree, the question is can you add a non-boi job on a BOI work permit? 

 

And do you know by any chance if the non-boi company will still be required to have 4 Thai's for each foreigner in this case?

I don't know, this could be an issue.

If the separate company wants to employ you, they will need to follow the law (enough capital and Thai / foreign ratio)

You could ask day job company to add your other job to their work permit.

If you’re not dealing with customers directly you’d be fine. But if someone has it in for you and dobs you in, you’ll have problems. 
you mentioned it’s all online. If so there should be no need for you to be in the office to do ‘work’. Have Candy Crush tab opened when you’re in the office and if authorities show up just say I’m visiting my company and playing games, “no working krub”.

Why would immigration visit?  

They don't  have the manpower to be trying to figure out where all the foreign owned businesses have their offices, or which offices might have a farang working in it. 

I regularly go to friend's offices in Bangkok and while I'm there I might sit at a spare desk to check my emails or facebook.  Never once have I worried that immigration might randomly turn up.
