Ridiculous comment. The Hormuz Strait is international waters than should allow free right of passage. Under international maritime law, the right of passage is generally deemed to take precedence over the territorial claims of neighboring nations.

UNCLOS Article 38

The Strait of Hormuz is a “strait used for international navigation.” Under the UN Convention on the Law of the Sea (UNCLOS):

  • All ships and aircraft enjoy “right of transit passage” — meaning continuous, expeditious passage without impediment.

  • Coastal states cannot suspend transit passage, unlike “innocent passage” in normal territorial seas.

  • No tolls or charges may be levied solely for passing through. You can charge for specific services like pilotage or navigation aids, but only if the ship uses them, and fees must be non-discriminatory.

Iran ratified UNCLOS in 1982 but with reservations. The U.S. hasn’t ratified it, but follows it as customary law. Oman also recognizes transit passage.

Under international law, there should be no tolls and no blocking of “non-hostile” vs “hostile” ships in transit passage. The current toll talk is Iran leveraging its geographic position during wartime, not something recognized as legal by most maritime states. That’s why the EU, U.S., and others are pushing back.
