A Criminal Record...?

Featured Replies

Hi, I am new to all this.......

I have a drink diving record against me........five years ago....I was not jailed, but lost my licence for one year.......I would like to retire to Thailand..........Would this conviction stop my application to live in Thailand....

No , over here they consider that a trivial driving offence,.

This does of course then beg the question.. When is a criminal record not a criminal record ??

Drink Driving is allowed to slide.. What else ??

The Immigration Act 1979 states that anyone who has spent time in jail in their home country is not allowed to enter Thailand. This does not seem to be strictly enforced in the sense that there are plenty of ex-jailbirds living and working in Thailand.

Like many laws, it can be used against you if the Thais feel they want to get rid of you.

OK so any crime that does not have a custodial sentence is OK then ??

Or is this simply another law thats not black and white and just shades of grey ??

The law is clear, but its eforcement is lax.

Like so many things in Thailand, it may be enforced in a different manner by different officers. But officially, unless it is a petty crime (I seem to recall he Act said words to that effect), any serious crime or crime where the person was sentenced to prison means that that person, officially, is not allowed to enter Thailand.

Like I said in the previous email, it seems to be a mechanism by which the Thai authorities could easily deport someone they found undesirable, if it was found that person had a criminal history in their own country.

Just apply for a single entry Non Imm O visa in your home country,

giving 'considering' retirement as the reason.

Then extend the visa once you arrive in LOS.

No criminal check required.

Not that I would think DUI would count anyway.
