Status of children with dual passports: UK and Thai

My brother, with whose unusual life some of you may be familiar, has now got himself into this position. He is in the UK with his 5 year old daughter. She goes to school. He is being a ‘single dad’. His wife is in Thailand, somewhere, neither sisters nor mother know where! Has not now phoned/spoken to child for a month or so.. He has a UK Residence Order on the basis that Mum has pushed off. Child is very fond of Granny and Aunties and vice versa-and he thinks it important to maintain the ties….so he would like to take her back to LOS for half term…But…someone, somewhere, aunts, uncles, friends etc. will surely will probably know how to tell Mum! The child would go in and out( he hopes!) on a UK passport…but what would be the position of the mother suddenly comes to ‘claim’ the child…It is I suppose an abduction question! Is there any protection affordable to a UK citizen in Thailand if they also have Thai nationality? The simple view is not to go. .but the child is the loser. Thailand-unlike Hong Kong -does not recognise UK Residence Orders-of course…So what should he do, do you wise people think?!

Sometimes you have to do best what is best for the child and that is not always the same as what the child wants. Stay in the UK.

Currently the ex wifes family dont know where she is or more likely to the point wont tell him so the legal status is irrelevant here as legal or not if the ex should kidnap her child would your brother have the time, funds or wherewithal to find her, as sure he wont get any help from the ex in-laws.

A youngster who has gone off with her mother wont be seen by the police as an issue that needs investigating, legal papers or not. (or it'll be very costly)

Better you spend the money on getting the Granny and Aunt to visit UK.

The child will have an underlying entitlement to Thai nationality, even if she enters Thailand on a UK passport, and the British authorities cannot afford protection against those of the country of which she is also a national.
