Hi guys.

Ok I'm currently on a "Family Visa" and the wife takes great exception to paying tax to prove a 10,000 Baht p/m income. Which she doesn't have but that's another story except to say the local immigration office were encouraging some dishonesty to get me that visa. I went for the Family Visa as I did not want to go to Bangkok but they sent me to the Embassey any way. However as the new visa regs are not any different to the old ones, or so I believe re combining money in the bank/monthly company pesion totalling 800k p/a. I am thinking of changing my visa to a Retirement Visa. So I would appreciate some opinions, change or don't bother.

The retirement extension of stay still requires the same 65k pension/income per month as stated in Embassy letter, 800k or more in Thai bank account for previous 3 months or a combination of income/bank account to meet the 800k per year figure. It is easier to renew for everyone and it appears will make the better half happy if you change.

I easily meet this part, so thanks for your IP. I think I willl let this visa run it's course that change it. The restrictions are easier than the FV any way. Plus I can now oncwe more fly up from down here for a return of not much more than a VIP bus ticket.

The Immigration officials seem to prefer foreigners to take the Retirement route, if it is possible.

It also isolates you from visa problems if your marriage breaks up, or wife pre-deceases you.

What means "in Thai bank account for previous 3 month" ?

My Non-Immigrant-visa, "O" single entry allows me to stay until Feb. 18th, 2008.

I intended to make transfer of 800.000 Baht into my BKK-Bank account sometime end of Dec. or beginning Jan.,

but that seems to late.

Even if I make the transfer today it would be to late, because the money would never be in the bank for 3 month

before I have to apply for my retirement-visa,

what I wanted to do sometime mid-January at the Immigration-office in Korat.

Is there a solution / could somebody please explain !?

For the three months prior to you submitting your TM.7 application for extension of stay to Immigration you must have had a bank balance of 800k or more if using the 800k bank deposit method. So no, you do not and can not meet that requirement and you will not be able to obtain a retirement extension of stay on your current visa entry using this method.

The solution is to use pension rather than bank deposit. That requires a letter from your embassy and the amount has to be 65k per month or more if only that is used - but if less you can combine with a bank account and still meet the requirements if the total is 800k per year or more.

If unable to use that method you will have to wait and do the extension of stay on your next visa entry.

I do not have a regular monthly income. I have larger assets of stocks and bonds in different european banks. When I need money for my living expenses I sell from this or use dividends or interest (that combined interest is unfortunately not 65000 Baht per month, but capital gain is usually important).

I'm 54 now, and my retirement payments start only when I'm 60.

I am married to a thai and we have 2 children together which also bear thai passports and go now in Thailand to school.

What could my embassy use for mentionning in that letter for the Immigration ?

If your name is on either of the Thai Childrens birth certificates you can get yearly extensions with no income and a small amount of money in the bank. Fathers of Thai children can stay with their kids if they are over 50 years of age.

Suggest you contact forum sponsers Sunbelt Asia or a similar organisation for assistance.

Some members have managed to do this on their own, but it helps to get some advise.

It would certainly be helpful to have a link to a place where I could find more about this,

or the numbers of the paragraphs and the name of the respective laws.

This week I'm going to the Korat Immigration Office just to check on the procedure and the documents they require.

I found it easy enough to understand:

I'm going to ask the visa on behalf of Section 7.17. (4) = parent of thai child (I have already all the required documents),

instead of 7.17. (6).

I had my wife read the thai text and she confirmed that it is absolutely clear and equivalent to the englisch translation.

What kind of difficulties might I encounter at the Korat Immigration-Office in order to ask for the help of an attorney ?

The section is 7.17 and the Criteria is (5), as in the quote you make of Lite Beer post. The reason you may need assistance is that this is a new provision this year and many upcountry officers have not been aware of it or how to apply it. It apparently was not designed for your situation but there is nothing to prevent its use - the original intent seems to have been so that Thai children would be able to provide for there aging parents as is normal in Thailand.

manaM I am glad you found it easy to understand because I do not. You should be ok with Korat Immigration as they have dealt with this before. If not then please contact Sunbelt or Isaan Lawers.
