Hello all

Need a bit of advice on the following situation:

Married to Thai wife for 3.5 years with a son who is now 3 years old.

Moved to the UK in late 2005 (after being in Thailand for 1.5yrs) on a settlement visa (obtained quickly with job offer and accomodation agreement)

Things didn't go well in the UK jobwise and it turned out to be a survival exercise until we decided to return to Thailand in Sep 2007 to regroup.

We have little if any evidence of being together in the UK (nothing in joint names or seperate names at same address)

We want to get back to the UK in March/April - have a decent job lined up along with rented accomodation. have approx GBP8k in the bank in Thailand. Son now has a Brit passport.

Question really is will we be OK to get a 2nd settlement visa? Are they likely to get 'funny' beacuse we left in Sep?

I was on to Home Office yesterday about more or less the same thing. From what I was told if you go back to Thialand (Together) then it was acceptable to stay longer than a few weeks. However its in the hands off the officer dealing with your application. best to save your air tickets and anything to prove that you were living in Thialand together during this period. You will have stamps on your pasports as well. would be interested to know the outcome.

Thanks for the reply. Not sure what the Home Office was driving at in your case; we left the UK at the end of the initial Visa period to avoid overstay thus want to apply for a new settlement visa to start again as it were. Not sure if I'm confusing the issue!

There's no reason why your wife shouldn't apply for a second settlement visa. You will need to demonstrate that your relationship has been subsisting and will have to work with whatever evidence you have. Additionally, write a covering letter which details why you returned to Thailand and why you will be seeking to return to the UK.

Thanks Scouse. It's all above board but the subsisting relationship evidence is scant to say the least; everything was in her name in the UK.
