To whom can help,

I have been living in Thailand for more than 4 years with a VISA based up legal marriage with a Thai wife.

This all went without a hint till it "appears" next year.

I now need to show legal notorized proof of income, HERE IT GETS TRICKY!

I am a Belgian passport holder (EU) but work for an US company.

The US Embassy can not notorize anything seeing I am not a US citizen.

The Belgian Embassy has nothing to notorize seeing I do not derive any funds from Belgium any more.

Further did I read in the POLICE OFFICE ORDER No.606/2006 under paragraph 7.17 -6 that:

When an applaicant whom is married to a Thai wife and has entered the country before this order has been inforced and has been premitted to stay based up on the marriage with a Thai wife only needs to show the BANK Gurantee of 400,000Bath.

Do I qualfy for this seeing I have been married since 2003.

Any advice would be greatly appreicated as I the Thai Immigration has only one solution = PAY TAX!

I believe immigration will only consider the 400k method for those that have used it in the past - but nothing hurt in asking them. If nothing else you need to get the wife working as the income does not have to be from you.

If you have a legal work permit and pay local tax on your income you might not need the embassy documents if you explain the situation and have enough alternative paperwork. But guess no tax rules that out.

I am a British Passport holder and i work for a US company.

My company wrote a letter on company Letter-headed paper stating my average monthly income. I then took this to the British Embassy with my bankbooks.

The embassy were then able to write the required letter for immigration.

Dear All.

Thanks much for your replies and help.

I did see in some other topics that when using the 400,000Bath bank gurantee before 2006 this would be OK and should void the need for any monthly income statements.

I will check this with Imigration and post the result.

To whom may be interested,

I found out that I need to show two bank books.

ONE showing the 400,000Bath with the bank garantee letter.

an OTHER additional book showing the fund comming in (not less than 40,000Bath a month) from an overseas account or foreing Telegraphic Transfer (FTT).

The FTT need to be supported by an official BANK LETTER, I checked this morning and they can do this.

This with all the other usuall paperwork ( as before) will grant my one year extension.

NO NEED To have the Embassy issue any document, as long I show the funds are comming from outside Thailand.

I hope this info may be usefull, of course I need to put this through the test next year!

Can you please advise which immigration office this was that you checked - sometimes are are differences so always good to know which one - thanks.

Hello All,

The info was obtained at the Phuket Town immigration office.

They were very unhelpfull and I had to be polite but insistant to get to an officer of some rank.

They are themselfs not 100% sure but after I explained my particular predicament they told me the Bank garatee and showing foreing influx of funds would be OK.

I told them the NEW THAI LAW under article 7.17 would void the need to show the monthly income but this was not appreciated.

A "fallang: explaining Thai Law was not on, they simply said you forget about the Thai Law and we will tell you how to do proceed.

Nopw seeing I get my salary from the US every month send by TT I decided not to persue the THAI LAW issue, no need to over cook the soup, I my case that is!

Still I agree, it should not be required!

Now obviously THAI will be THAIs and they want to see more money hence forward they push the PAY TAX WAY by or through the spouce solution.

Thanks PTV for the info bt I would love to hear from someone what the actual requirements were from Phuket immigration who has actually been through the 40k per month process based on:

- extension of an O marriage visa

- under 50 yo not employed in Thailand (off shore work only as part time consultant or the like)

- using offshore savings/interest as income and transferring these to you Thai bank once a month

As much info on this as possible would be great as I gather a number of us are facing the same dilemma.

Are you on an extension or renewing your visa. I am in the same boat boat as you and haven't heard about "notorized proof of income" I just get a letter from the bank saying I have 400,000 and a statement for the previous year with the foreign transfers. I have to renew my extension in May and will not be happy if I have to go to the British Embassy in Bangkok.
