Hi,

My girlfriend currently lives in her flat in bangkok and works for a Financial Company. We have recently submitted a visa for her to visit me in England for 2 months. This application was refused as she only gets 10 days holiday and she has not asked the human resources department for leave.

We did not get an opportunity to advise the Visa Embassy that she has asked her manager for 2 months unpaid leave but she said no. Therefore my girlfriend was going to resign if she could get a visas and then get a new job on her return.

She will definately return to bangkok after 2 months as she has her flat and supports her family in her hometown.

My girlfriend has no leave until next year as we just spent 3 weeks together in Thailand. She took 10 days holiday.

Any advice on what we should do, would be very much appreciated.

The reason most applications for a visit visa to UK fail is that there is no compelling reason to return to Thailand. Having a job and being on leave are probably one of the best reasons she could give however producing evidence that she has a lease on a flat and supports her family also go a long way to proving this.(did you submit that evidence last time?)

As she is only your G/F you are not afforded the facility to appeal so really the only course open to you is to re-apply.

Telling the BE that she intends to resign and reapply on her return will not help her case as with you based in UK and her having no definite time scale to return there is a clear likelihood, in their eyes, that she may choose to remain or overstay in UK.

Probably the best would be for her to seek a new job now and arrange the start date to be soon after she intends to return to Thailand and have the new employer give her a letter of appointment with a start date on it. Then when you make your next application explain in a covering letter why she had to resign and apply for a new job.

How long have you known each other? How much of that time have you spent together? Whilst apart have you kept in contact? Can you demonstrate this? Etc.........
