I am coming up to another visa extension based on marriage to a Thai national. This will be at Pattaya Immigration. I have already had five extensions so I should be able to use the 400k requirement under the grandfather clause. Is this for sure ? I ask this because I seem to remember the Officer last year telling me that this year I would have to show 40,000 income. I can in fact do this but I shouldn't have to, right?

I had a four year of extensions last year and they told me to do the same in 2008 with 400k at least 3 month prior to app in BKK Head Office.

In the OPs case the law actually says.

He or his Wife must have a total income of at least 40,000 Baht a month.

If the Alien DOES NOT have the minimum income he must have a bank deposit in the name of either party or both of not less than 400,000 Baht. Proof of 3 months deposit is required.

Technically if he has the income he must do that. However if he does not tell them he has the income he should be able to do the money in the bank.
