Most, if not all western countries, & probably a significant number of other less developed countries have laws that are used in the cases where one individual is over the 'age of consent' but under the 'age of majority' (in most cases 18 years old) & there is a 'socially unacceptable age gap' (set by the prevailing culture) between the parties involved.

The police then have options of charging the adult party with 'statutory rape', especially in cases where the adult party is in a position of power or authority.

In this case a 14 year old & a 45 year old with the adult party in a position of authority.

Like I have previousely stated - the age of consent in Spain is 13 years & if you as an adult (I am assuming that your are an adult from your avatar, please correct me if I am wrong) go to Spain & have sex with a 13 year old girl (over the age of consent), you can expect to charged with the local variation of what is commonly known as 'statutory rape'.

My comments may be trite, but the question remain unanswered...

Do you think it is acceptable for an adult to have sex with a 13 year old child in a country where the age of consent is 13 years of age?

As to addressing the state of my 'major malfunction', I am beginning to think that it pales into insignificance compared to yours.

You are mistaken of how age of consent work in most countries.

Example: Age of Consent in Sweden is 15 years old. From that age you are legally able to have sex with anyone else above 15 years of age - including 45 year olds.

Edit: In fact, your example with automatic rape/abuse charge is in many countries only applied if one party is UNDER the age of consent and the other party is OVER the age of legal adult (18 in some countries, 21 in some, and so on). This to give a slight leaniancy for cases where a 15 year old has sex with their 14 year old partner, and so on ('close in age' exception). Age of consent means age of where the party involved are deemed old enough to give consent to sex on their own. Your example does not accurately describe that.

Btw: The age of consent is 13 in Spain. And you are incorrect in stating that a 45 year old would automatically be charged. The only addition to the 13 year old rule is that if deceit is used on a person under 16 years of age to gain the consent, one can be charged for it. This however not only has nothing to do with the case in question but is also a heritage of a culture artifact that we don't need to address here.

What you say is correct, when there is a sexual relationship between a child over the 'age of consent' but under the 'age of majority' & an adult, the age disparity between the two has no bearing at all, & it is perfectly legal. I was wrong in my interpretation & apologise for my mistake.

This all changes very radically as soon the adult party is deemed in some way to be in a position of power or authority, for example, teachers can expect to be jailed for having sex with a student, even though that student is over the age of consent. There are numerous documented cases of teachers being jailed worldwide, but not a lot of specifics on the actual charges.In one case, a teacher in England, who had sex with a 16 year old student (over the age of consent) was charged with 'sexual activity with a child' & 'abuse of trust'.

Regarding the Spanish example of a 45 year old having sex with a 13 years old, I think that you will find that the police/prosecutors are extremely vigilant in pursuing these types of cases. You are correct in saying that charges are not automatically laid, but rather dependent on a parent making a complaint, & in this light my use of the phrase 'expect to be charged' seems to be appropriate.
