HELLO GUYS, I NEED SOME HELP PLZ!!!!! I GOT MARRIED IN DEC 2004 TO A FRENCH MAN (STILL TOGETHER), I'M THAI AND NOW 64 YEARS OLD. I CAME TO JOIN MY HUSBAND ON SEP 2005. HE THEN REFUSED TO SIGN ANY PAPER WORKS TO THE HOME OFFICE. GOD KNOWS WHY? THEN, I SENT ALL MY PASSPORTS TO THE HOME OFFICE ASKING TO BE GRANTED EXCEPTIONL/DISCRETIONARY LEAVE TO REMAIN WITHIN THE UK ON COMPASSIONATE GROUNDS (2005) I HAVE NOT HEARD FROM THE HOME OFFICE SINCE. NOW I'M ILLEGALLY LIVE IN THE UK WITH FEAR. WHAT SHOULD I DO PLZ? (PLZ EXCUSE MY ENGLISH GRAMMAR)

I WANT TO LIVE IN THE UK.

MY HUSBAND LOVES ME AND IS CONTROLLING AND TOO JEALOUS. :o (DOMESTIC VIOLENCE FORM) AND I'M SCARED OF HIM.

If you are still married to the Frenchman and both you and he live in the UK, you do not require any further authority from the Home Office to be able to remain. If you separate from your husband, and subsequently divorce, again you can't be required to leave as you will be considered to have residual rights of residence. If you want to leave your husband, then do so. Get your passport back from the Home Office and make an application for a residence card based upon your residual rights.

thank you for your reply. I really admire your brain. I do apologise for using the upper case.

As my EEA visa stated valid from 19/09/05 valid until 19/03/06. Before my visa expired me and my Frenchman should have completed the FLR(M) and SET(O) forms.

I was given some advice to stay low profile by a solicitor. But I'm sure that there are some other ways around to be legalised as we are still living together.

If I ask the Home Office for my passport back, I'm scared that they will deport me.

From the circumstances you have described, you are not in the UK illegally.

Because you are the spouse of a European country citizen rather than a British citizen, you do not need to extend your status: you can just stay. Additionally, because you have been married for more than 3 years and have spent more than one year in the UK, if you were to now divorce your husband, you would not be required to leave the UK.

If you wish, you can apply for a residence card from the UKBA which will confirm your right to stay.
