I am not a US resident or citizen and have filled in a W8 with my broker.

Yes, with a W8-BEN filed 10% will be withheld at source. But if your country has a tax agreement with the US (most nations do) then it will be applied as a tax credit. It's either 10 or 15%, I can't remember exactly.

yah...it's 15% tax withheld for dividends only...capital gains are tax free as far as the us is concerned.
