I am facing the prospect of downsizing in my organisation of salaried employees. This is happening across our organisation globally for obvious reasons.

I contacted our lawyers about this. I know that if you fire someone here, it's better to get them to resign. I asked them specifically what we needed to do when downsizing and I was advised to attempt to get them to resign or potentially face unfair dismissal proceedings.

Now - I know that in 2000, Seagate laid off 2900 people in Thailand and I don't beleive for a second that these people all resigned. I also know that many Thai companies will be facing the same problem as business is pretty tough globally right now.

Is there really no difference in how you handle downsizing and how you handle firing people ?

Any ideas ?
