My girlfriend is presently divorcing her scottish husband. Our solicitor has taken 4 months so far and everytime we call he says that he can not do any more because the documents are in the hands of the UK embassy, Does anybody know how long it takes to divorce and what the process actually entails

Basically she has no contact with scottish husband, in fact, she doesnt know where he is.

There are no assetts to divide and no money involved .

she just wants divorce and to forget him.

somebody must know what goes on with divorce what should be a simple case. Is there anyway of checking up on the process or even any way of speeding it up...

please help

Hiya mate,to begin with im Scottish but the reason im replying to this is that i got married in Jan.My wife was worried cos her pal is married to an English guy and has been trying to get divorced from him for 7 years.It could be done quick if yous could get hold of him to go and sign papers etc,if not i am sorry to say you could be in for a long wait.Sorry to be the bearer of bad news.

Which country do you live in and which country does your girlfriend live in and which country does your girlfriends husband live in?

I got a divorced with a person living in the same town in the UK it took just under two years. A good friend of mine living in the UK divorced her Indonesian husband and that took 7 years as he was living in Saudi Arabia.

I think that if you are living in different countries it's a laborious process and that living in different countries can hinder the whole process.icon5.gif

That would (presumably) be why it is taking so long. Your solicitor has to find the husband and serve him with the divorce petition first (it could be serving him through the UK Embassy, if the Embassy knows where he is), even where it is a case of desertion or 5 years' separation. If he can't be found it does take time before the court will be satisfied enough to grant the decree nisi.

The only way of speeding it up is to find out where the husband now lives.

By all means keep chasing the solicitor, but remember that he/she technically works for your gf on the divorce and not you. Good luck!

maybe you are the next alimony payer

why such a rush to marry annyway ? take a carreer break and come over here for a year

maybe you will see a differtent, hidden part of your wife wannabee that you otherwise would never would have seen

england or other west-european countries are so cold, no family, no thai food, no friends, no sun ...

i guess thai woman are like the thai national anthem where they sing about : thailand is for thais only

do not think thai woman "grow" well in other countries, except into a painfull divorce and come back to their country here with plenty of a lot of your belongings

I was marreid twice to thai's

Both ended in divorce. Both times were 100% registered and legal.

one we had a child.

Both times i had to obtain a lawyer who petitoned court and filled for divorce. Both times I went to court without the wife ( as she could not be found) and it took less than 6 months from start to finish. With my second ex i also obtained full custody of my daughter.

I have no idea why your lawyer needs to find her ex and if you want the name of my lawyer in Phuket let me know.

BTW total cost was only 50,000 baht and the last divorce was 5 years ago.

I married a Thai woman in NZ, after a month we separated, she was a B#$ch, I spent the next 15 yrs not able to marry again, real bummer. then in 2006 I went to the Surin court and asked for a hearing, after three visits [one day a month] I was presented with the Full Divorce, cost of paperwork, 20 baht!!

It wasn't until I had the documents translated that I found out that they had granted me a full and final divorce. Before the Court case, I had been to the local police station and received a written document to the effect that I had been separated from her for a long time, the police were very helpful!

I feel that in this case, it will be necessary to prove separation in some way, letters from Local Pu Yai [village chief] and local police would help.

Not much use if she is living and petitioning for divorce in Scotland.

Agree with the above that the OP's lady's lawyer is dicking her about. There's no need for the Brit Embassy to be involved until AFTER all local legwork through the Thai courts. However, the OP hasn't specified WHERE the lady in question is seeking a divorce, in Thailand or Scotland.

I got divorced from my first Thai wife in Thailand on grounds of separation. Even after she did respond very late to my petition, the court moved very quickly in my favour when she missed 2 court dates.

If your lady has the original wedding certificates then getting an annulment on grounds of separation should be easily done through the Amphur where the Thai marriage was registered.

However, if this lady was married in Scotland, then I can see where there may be problems but once again, it does NOT involve the British embassy. As far as I am aware, the embassy does not provide a service to locate a person, the lawyer should have done the search through whatever channels he decides best but only if your lady has paid him to do so.

If remarrying, all the embassy needs is to authorise an affidavit for freedom to marry for the foreigner and the Thai respondent has to furnish similar certificated documentation of elligibility. That's the only involvement I see from any embassy in any marriage or remarriage scenario. They have nothing to do with divorces.

Ok, sorry i did not give all the information......they were married in thailand and registered at the amphur.....they were together 3 years then marrried and then he finished with her and has never returned to thailand....he cant, he is a bad boy and wanted by police in uk and thailand....i have spoken to his cousin in scotland who says the family have no idea where he is or if hes alive.

So there it is.....what is the solicitor meant to do......he has sent documents to the embassy and is waiting for there return. but it has taken 4 months already.....all i want to know, if any one knows, is how long should this take, what happens next and approximately how long......can the solicitor do more and any other details regarding Thai vs falang divorce procedures.

Bloody nightmare, but shes paying for it at 75000 that took her 12 months to get....so far.....shes not happy but cant afford to do it again with a differant solicitor.......

If the marriage was registered in Thailand, can't you both go over there and get it done in Thailand. It will probably take a fraction of the time and be a fraction of the cost. UK solicitors probably rub their hands in glee at this kind of case.
