Visa Options After Work Permit Expiry

Featured Replies

Hi,

Being a 50+ Dutch resident in Thailand and married for 15 Years with my Thai girl and our 2 boys, I'm trying to figure out the best way to legally extend my stay in Thailand. My current contract was terminated prematurely due to the economic crisis and I hope to benefit from this forum's suggestions regarding the options to stay in Thailand.

As my last stint in Thailand lasted only 2.5 years, I unfortunately do not yet qualify for a resident permit.

In particular I'd like the forum's advise regarding the following:

- Do I have to leave the Kingdom, if a next visa would for instance be based on Marriage status?

- It is not my preference to stay on a retirement visa, as I understand this would disallow employment, are there options besides the marriage visa?

- Is it true that when the employing company prematurely terminates an employment agreement (abiding the notice period) that severance pay is entitled, and if so, does this apply also to expatriates like myself?

Look forward to your views.

Are you on an a one year extension now for work?

If you are on an extension you can change that extension to one based upon marriage to a Thai. You just need to show 40,000 baht income or 400.000 baht in a Thai bank for 60days. For the income you could show tax payment documents for proof. You need to do this before you termination date.

You can get a work permit with an extension or visa based upon marriage.

You are entitled to severance pay the same as a Thai.

Thanks for your reply, I am not on an extension, 6 month ago, I changed Employer and a new permit was issued.

Though applied for 5 years, I understand it will invalid with the termination of employment. The current Employer does not wish to break the law and extend beyond this.

If you want a bit of breathing space. Immigration will give you a 60 days extension to visit your family.

Marriage Extension 2.18(6)

60 day Extension 2.24

So you are on a multiple entry visa. That means you don't have to leave until your current entry ends. Your visa is not tied to your work permit. If you still have time left on the visa you can even make additional entries.

You can get a marriage extension of a non-b visa entry.

Thanks, that at least gets the pressure off a bit

As Joe said if you are on a Multi Entry Visa it is still valid until it expires.
