what shd i do with my husband's visa? he has been here for over 1 yr and keep on going to the border to get it extended, he's on 2rist visa. then he goes to Laos to exit Thailand and go back to the border again. he once had 3mths non-o coz we've got marriage certificate, however when we tried to extnd his non-o visa to 1yr it was denied. the immig said our cert was not recognized by the embassy, that is why he went back to have tourist visa again. we got married in thailand, we're filipinos. phil embassy could also not recognize our marriage certificate because we god married at the church. we should get married at the embassy or municipal,,very costly!!! and too much paperworks,,,is there any way i could do to get a longer visa other than tourist for my husband??? i got a non-b, what about him?

  1. Do you have a marriage certificate from the church, the certificate being legally recognized as such in Thailand, and if so why won't the Philippine embassy accept it? I can't believe that everybody married in a church in Thailand is not legally married.
  2. If you did not have the required paperwork, how did you get married in the church? Did you get a Permission to Marry clearance certificate from the Philippine embassy prior to the church wedding? Did you register the marriage with Thai district office?
  3. What kind of visa or extension, and work permit if applicable, do you have? When is it due to expire?
  4. Until you get the marriage recognized by the Philippine embassy and/or immigration, your husband will have to make due with Tourist visas or a Non-Immigrant "O" if he can cajole a local Thai consulate into providing him with one. Visa runs to the border every 15 days are not the answer.
  5. As you already know, a 1 year dependent extension for your husband will require you to sort out the marriage paperwork.

It seems that they also have a son , see previous topic "Visa For My Son! Pls Adv Me ASAP!", who has documentation concerns. Whatever their gender, they need to get their affairs in order.

The problem is that you are not legaly married. You could get married in Thailand, but you will need some papers from the Filipines and have it legalised. That will cost you some, but in the end will save money. The actual marriage at the amphur in Thailand is free.

The only other way is an educational visa, but that would even be more costly.

Marriage in Thailand is legally registered at the local amphur.

Marriage in temple/church is only ceremonial.

thnks guys for your comments. that would mean that i need to prepare all the docs from my country and get it authorised here in the embassy or amphur, whatsoever and then re-marry my husband! (sounds good coz friends and visitors gives money on the wedding,hahahhahaha joke!!!)

honestly speaking, i even had a doubt already that our marriage was illegal but wasn't sure how the thai law applies to us with regards to matrimonial stuff.

Your marriage was not illegal, simply not recognised by law only by the church.

But you might have another small problem, as I understand from your other thread you also have a son. Since you were not legaly married it is not clear if the father is the legal father of the child. When parents are not married the father of a child has to recognise that the child is his. You might want to check if the father has legalised the child.

The marriage was discussed as it is possible for a spouse to get a visa and extension of stay if the other spouse has a 1 year extension of stay, based on for example work, retirement or education.

Unfortunately in this case OP is not legaly martried and so they first have to get a legal marriage.

The husband and son could get a dependent extension (2.20) after their marriage is recognized/recorded by the amphur office. They, the husband and son, need a Non-Immigrant "O" visas before they can get the dependent extension. This assumes that the wife has a legal Non-Immigrant "B" or work extension.
