Received an email from a friend in Thailand, presently staying in Bangkok, who finds herself in a quandary. Anyone here give explicit advice?

Position

Present visa is a 'retirement' Visa which has been renewed several times [800k in bank]

Last renewed on 6 November 2008 outside Bangkok, with expiry 13 November 2009 with no re-entry permit.

Last border crossing 16/08/08 at Suvarnabhumi from Singapore.

Questions

1. Is the 90 day report due based on 6/11/08 or 13/11/08 date? If 6th I think that means 90 days was yesterday. Is there still a leeway of x? days before and after?

2. What does she put on TM47, the arrival card data or the renewal data? I'd assume the arrival.

3. If she enters the arrival data on the form, will the office [bangkok] 'get' the 'reset' of the renewal, or should she point it out specifically.

[Note] Like many here here Thai is limited to 'hello thank you etc.'.

Her concern is that prior to this she has often been travelling so she's rarely had to report a 90 day stay, and she's a little uncomfortable with officialdom.

Her 90 days started on 16th August 2008. So she has missed it by a long way. Unless she did a 90 day report in November.

Suggests that she goes to Immigration and report. She will be fined 2,000 Baht if she is late but she will be back on track.

On her form she puts the date on the arrival card.

Unless she did a 90 day report when she did her extension her 90 days started 16/08/08 and should of been done 90 days after that.

Suggest she fill out the report using 6/11/08 and get to immigration within the next few days.

Reports can be done 7 days before or after the due date. If not then it is a 2000 baht fine.

It would be a good idea for her to have 2000 baht handy in case they fine her for not reporting for the 90 days after she entered the last time.

Yes. Extension applications have nothing to do with 90 day reporting. They are two seperate things.

Thanks again, as an aside I got a message from a friend who having looked at your responses, noted 'He'd been getting away with it for the last 3 years' [i.e. renewing within the 90 day period, and subsequently making his next 90 day report based on the renewal date] though he is well outside Bangkok. He also commented that next renewal time he'll make a 90 day report as well 'just in case'.

I think even the 90 day reporting like many other things will vary from office to office.

The office I deal with that is far frim Bangkok started my 90 days on the date that my extension was stamped in my passport after the 30 day wait for a marriage extension to be approved.

Officially the 90 day clock starts on the day you make your 1st application for extension. After that it has nothing to do with applications only 90 days continuous stays.

The clock will only be reset when you leave Thailand and re-enter again on a re-entry permit. When re-entering your 90 day clock will start ticking from day 1 again. So re-entering Feb 1, means Feb 1 is the first day of your 90 days.

My circumstances are as follows:

24 December 2008

Crossed through Chong Mek Thailand/Vangtao Laos border for 2nd part of double entry TR 60 day Visa.

Admitted 24 Dec 2008 until 21 Feb 2009. (Departure Card with same dates)

29 January 2009

Applied for Change of Visa from TR to O Non Immigrant at Khemarat based on retirement

Received O Non Immigrant Visa 29 January 2009.

Admitted 29 Jan 2009 until 28 Apr 2009. (No change in Departure Card - same as above)

The Immigation Officer gave me a 90 day Reporting form and told me to come back for a 12 month extension in 2 months!

Do I do 90 day Reporting starting from 24 Dec 2008 or 29 Jan 2009?

Any assistance would be greatly appreciated.

Since you haven't gotten an extension yet to be safe I would count the days from 24 Dec. since that is when your entry started.

Related question. Based on my last reporting of address, my 90 day report date is 6 april 2009. On 2 feb 2009, we notified Immigration I had moved, and I completed the change notification form. Officer stamped and stapled it into my passport, without it having another due date. I now have two forms in my passport, one of them marked for renewal on 6 april. So should I go back in on 6 april?

Yes, go on 6 April.
