I am planning(or was) to apply for a visa extension on the basis of being an unmarried father .......i will have all the paperwork necessary but my friend went to apply at the helpful immigration office in Jomtien and was refused and told he needs to get the court paper to say he is the father etc. He had all the required paperwork in order,registered the baby at the local amphur,he went to immigration with the mother(his long term girlfriend) and the baby so now hes going to have to go to court. I dont know how that works? do you have to get a lawyer? Is there a long wait to get a court date? what do you do when you go to the court? it seems like just another hassle and they should have give him the extension without all this bull. Anybody else gone through this yet? :o

A friends of mine was in the same situation at the same little office, he went there for a different matter but he's been offered a full year stay on the basis of his daughteer(he just mentioned by chance of his daughteer and promptly they offered the service, good customer service eh?), nevermind he had little documentation about it, but it seems they where expecting a "little" perks afterwards, if i was in you i was going directly to bkk or any other office where they use different working standards and because of the new law that say you have to go to the relevant office where you reside, just take a small holiday for sometime and give them that address....good luck and let us to know about it

Jomtien has been reported asking for this before. Whet the court order is for is sole custody of the child. This clearly is not needed since they are living as a family. And the mother going with him and stating that fact should be enogh. Going to court can be a long and costly process.

Bangkok does not ask for it. If he lived in Bangkok he would have his extesnion tday.

What I suggest he do is what it says on page 2 of the police order.

In case the applicant wishes to review the denial by the orders mentioned in clause 1, the applicantshall re-submit an application for another review, citing the reasons for the re-submission in a letter to a competent official holding a rank of a police inspector and higher. This is for the purpose of obtaining a decision in writing on the application. In this case, the applicant may attach all supporting documents to the application for re-submission at the same time. The review shall be carried out within the time limit prescribed by paragraph 1. During the proceeding of the consideration, the competent official shall set the date of result hearing within 7 days after the review application is submitted.

This would cost almost nothing and might help others that want to apply for the same extension.

I recently saw a report from a member about applying for sole costudy. Will take about a month, if all parties (father and mother) agree. But will also depend on how bussy that particulair court is.

Agree with Joe that in the case of them living together as a family sole costudy is not needed.

Edit:

Did they try to change the costudy at the amphur? beleive that is possible if they both agree. Not sure, but would be much easier, cheaper and quicker. So let them call the amphur first if they didn't do that already.

I think its just thai bull s h i t again, they dont wanna do the paperwork so send you somewhere else or maybe he was looking for a payoff and my friend never offered. He has his name on birth certificate and everything legal ,correct etc.......i like the answer that he should ask to speak to some one higher, thats a good way to get the cold shoulder from them.....they would just say go away and maybe not even as politely as that. Maybe when its my time i will go to Bangkok as my lady has a house just outside but then will i have to go to report there every 3 months? and the birth certificate will be done in Pattaya.......so probably problems. I like Thailand but sometimes its like banging your head against a brick wall, they make the laws/rules then dont stick to them. i think il just do the done thing and pay over the top as seems the easier way hence why they make it difficult.

The birth place of the child is irrelevant. It is your registered address that determines which immigration office you must use. When you move residence, there is a form to notify immigration of your change of address.

I think it is sole custody the want.

To make him the father does not require a court action. That can be done at the Amphoe by doing a legitimization registration. Link to info on doing this: http://www.dopa.go.th/English/servi/myson.htm

thats all well and good but he is on birth certificate and has been told by immigration twice he has to go to court then the amphoe then back to immigration!!!

today went to immigration jomtien and was told that we must go to the court to get paper there as birth certificate not enough.......he said the government made this rule???!!! cost is 25k including his lawyer , he said easier to just get married.

Has anyone done this extension easily yet with just birth certificate and necessary funds?

Shall i go Bangkok with the certificate , my lady has a house just on outskirts......will they want me to go to the office every 3 months as i dont fancy driving up there everytime, the idea of getting the extension is to make things easier.

More advice welcome.

Give Bangkok a try. Remember you may have a wait period while they consider your application. That could include a visit from them or the police to check that you all are living together.

After you get the extension approved you could just make your reports using your Pattaya address.

i think youre right, its just a money spinner...they must have staff meetings and talk about how they can get money out of farangs...and then come up with an extra rule that fcuks everyone over and gives everyone a share...lawyer,them and the court!!!

i cant think of any other answer to it.

if i do it at bangkok i dont really want to hang about at her mothers waiting to see if they visit,that would be like torture....maybe il just get married to save all this <deleted>.
