My wife has just applied for ILR on a spouse visa a couple of weeks ago. Her visa expires on 9th July. I though everything was bang in order, but have had a letter back from UKBA today with the following message on it:-

"Thank you for your application for settlement in the UK on the basis of your marriage.

To help me consider the matter, please send me the following documents. Please send ORIGINAL documents as photocopies are NOT acceptable for the purposes of deciding your application.

Documents required:

1. Evidence that you have knowledge of life and language in the UK to our required standard. For more information see our website at www.ukba.homeoffice.gov.uk. Please provide evidence of your level prior to commencing your ESOL course so we can see evidence that you have progressed."

Now, I enclosed the following original documents:-

1 ESOL - skills for Life (Speaking and Listening) Level Entry 1

2 Confirmation of achievement of a Certificate in English for Speakers of Other Languages (ESOL) Skills for Life delivered within a citizenship context (covering letter + actual certificate)

I assumed that that would be sufficient. However, may be not.

I have checked through her course work from the ESOL course and can see no evidence of an initial test. They did pre-test her. Should I ask them for a copy of their initial test?

Any ideas and help would be most appreciated.

The requirement is not just that she took a course and passed it, but that she were judged to have a starting level of x and after attending the course and passing the exam, she now has a level of y. You need to get on to the college that she took her course/exams at and ask them to write a letter outlining their initial findings and how your wife has progressed.

I havnt heard of this happening before. When my wife got ILR last month we didnt show any evidence of her initial ESOL standard. We just showed pass certificate in ESOL level 2. Im baffled by this, maybe someone more knowledgeable could help you . Seems very odd to me.

My wife has just passed ESOL level 1 after 5 months on going to collage is this all she needs to do or does she now need to pass ESOL level 2 to get her ILR any help with this would be greatful as the time is runing out for when we have to get a ILR visa
