On another post, I indicated that my wife had had a request back from UKBA asking for evidence that since commencing her ESOL course, she had made progress.

Upon enquiring with the council funded Language Resource Centre (LRC) which issued her with her certificate (ESOL Level 1 + citizenship), they have admitted that they have actually made a mistake. They gave her an initial pre-test before starting the course in November last year (which unknown to us indicated that she should be doing level 2), however, they actually started her on level 1 and allowed her to complete the course. We therefore unwittingly made the application for ILR assuming everything was OK.

The LRC have offered to write a letter indicating that it is their error. In addition, they will allow her to sit a level 2 exam on Thursday 2nd July, which they feel comfortable she will pass as her English is now much improved (reading, writing, spelling, speaking). The only problem with this though, is that the certificate from Edexcel will take a month to come through. They can though, immediately provide a letter indicating that she has passed Level 2 and is awaiting the certificate. All this can be forwarded along with a covering letter from both of us back to UKBA, before the required date (10th July). This is the main problem though. My wife entered the UK on her visa on 9/7/07.

Any answers to any of the following questions would be much appreciated:-

Do any of the BMs think this will all suffice and she should be granted ILR?

If so, will they do this on the strength of the evidence provided or will they wait for the Level 2 certificate?

Is there anything missing / any specific wording which I should include when sending all the information back to the case worker?

Any other advice / information?

All you can do is explain what has happened as you have here, saying that you will forward the letter from the LRC when recieved (don't forget to ask them for it!) and trust that the UKBA will see sense and delay the decision on her ILR until she has sat the exam.

I cannot see any reason why they would not do so. Let's hope I'm right.

i really hope your right 7by7, and i have my fingers crossed for you london , but i have to say and i really 100% hope im wrong, i feel the dim wits at UKBA, will change your application to one of further leave to remain, till you can send them the certs.and with that desion there will be a further visa fee to pay, fingers crosed mate, keep us all informed.
