The People's Alliance for Democracy on Monday filed a lawsuit with the Criminal Court against Prime Minister Abhisit Vejjajiva, Deputy Prime Minister Suthep Thaugsuban and Police Chief Gen Patcharawat Wongsuwan for abuse of authority.

The lawsuit was filed by lawyer Nathaporn Toprayoon, who was appointed by Chaiwat Sinsuwong of the People's Alliance for Democracy, to represent the 36 PAD leaders who have been summoned to hear criminal charges, including act of terrorism, in connection with the PAD's seizures of Don Mueang and Suvarnabhumi airports late last year.

Mr Abhisit, Mr Suthep and Pol Gen Patcharawat, who were responsible for overseeing police, failed to properly perform their duties allowing police investigators to have made too severe charges against the PAD leaders since the protests at the two airports were only political gatherings.

The court set Aug 24 for examination of the lawsuit.

I expect it is just court tactics and being used as a delaying measure - No wonder the courts in Thailand cannot cope and cases take years -

It's simply about way too survire charges "Terrorism"... and what the heck - have the Reds from Songkran being charged yet - their charge should be Mutiny and trying to abet the people for a revolution, treason and high treason!

Am I reading this correctly - PAD have filed a lawsuit against the PM and others for not stopping them from occupying the airport??

That is at variance with my interpretation. My understanding is that they feel that they are being treated unfairly harshly. Totally in keeping with the Thai psyche I fear.

So they are not claiming that they haven't broken the law but that are being treated unfairly by being investigated for breaking the law and have taken out a lawsuit accordingly - no wonder the law here is becoming a joke.

They're saying that, whatever you think about the occupation of the airport, the charge of "terrorism" is excessive. The charge itself is irresponsible and police should have been restrained from coming up with something so extreme.

Some may think that the peaceful occupation of the airport (after it was abandoned by AOT) equates to 9/11 or suicide bombings, but PAD would not agree with them. They have a justified complaint against police and ministerial irresponsibility in this case.

Since when was it the job of a prime minister (any prime minister) to oversee police investigations?If the PAD win then I'm suing the PM too. The fine of 500 baht i received last week for speeding was much too severe. The PM failed in his duties by allowing investigators to make too severe a charge. Anyone know a good lawyer?

That would have started a riot. The last PM didn't want that so they were ordered not to. You see the results of the other protest with this PM. Its just what he wanted as a result.

They can't charge one and not the other, its just for looks which shows the level of corruption has not changed one bit after dear Thaksin has gone. The result of the charges won't be the same.

If you want Thaksin locked up it would be a good idea to take the lot of these with him. Nothing has changes one bit. Meet the new boss same as the old boss.

Greenwater, I didn't agree with the occupation, but it does seem that the AOT head closed down operations very quickly. The PAD went there to give a rowdy reception to PM Somchai on his return from overseas. Next thing they found themselves in charge of an airport! Bizarre? Yes. A setup? Perhaps. Who knows what really happens in this Looking Glass Land. Certainly the occupation was not "terrorism", though some like to call it so for their own purposes. (PS. Am I redcarded if I'm a PAD member or for my unwelcome comments? :D )

I don't think so.Despite your attempt to backtrack (I didn't support the occupation etc etc), your essential message is that it wasn't the PAD's fault but that of the AOT who closed down the airport.Morally defective and intellectually dishonest seems about right.If someone holding your views was cross examined in a court of law say by a first class English QC, the dishonest position you peddle would be quickly exposed.

Typically farangs have not attended political events, so they are easily convinced of this. A key media agenda is to avoid the perception that there is a struggle for electoral Democracy in Thailand. So it suits their agenda to focus on comparative trivialities between these two groups, instead of substantive differences. The pro. vs. anti. democracy differences aside, functionally there is a big difference also. With PAD protests, one saw military type encampments, with what appeared to be professional type perimeters, piled high with tires and other fortification materials. None of that is visible at any Red Shirt events. This difference speaks volumes. The PAD was a military supported operation, evidenced also by the military's inaction at the airport. Another huge difference was the comparative conduct of the two groups when they besieged Government House. Whereas the PAD trashed the place, including extensive thievery, the Red Shirts merely encamped outside the main grounds. These two groups are different type people one characterized by coercive, authoritarian, militia type organizers and operational tendencies, whereas the other can be organizationally described as a citizen's protest with no militia type elements. That is also why PAD supporters can so easily accept the more authoritarian appointive process as opposed to an electoral one.

Yes, Black Songkran was indeed an event filled with peace, love and understanding from the Reds. No Violence there. Neither was there any violence when red elements attack the PADs camps during am multitude of nights last year with grenade launchers and other weapons. :)

Songkhran? Placing LPG trucks laden with gas in residential areas and threatwening to immolate them.

Edited to add: Murder in Chiang Mai, attacks on not only yellow shirts but also demonstrating corn farmers, peace advocating red groups, HIV awareness groups. Then we get into the inital red-yellow clash where after listening to speeches of govenerment leaders armed red groups from Sanam Luang walked several KM as police parted to allow them through so they could assault the yellows at GH. No militia elemnts does not really describe this

the reds like the yellows have their guard and attack units who are armed and they both also have their masses of peaceful citizen's to show to the media. They are not different this way. There was prior to Songkhran an attempt by some to create a myth that the reds were entirely peaceful but it broke down over Songkhran when elements did become violent and certain red leaders encouraged it.

This is a vicious intra-elite power struggle and all sides will revert to violence in order for their group to win and be able to run the country for their version of the elite.

Court dismisses PAD's counter lawsuit claiming trumped-up terrorism charge

The Criminal Court on Tuesday cited a lack of cause for judicial review to throw out a counter lawsuit claiming police fabricated terrorism charge related to the Suvarnabhumi Airport seizure in December.

In countering the police work on the airport seizure case, People's Alliance for Democracy co-leader Chaiwat Sinsuwong petitioned for a judicial review.

The counter lawsuit named the case investigators and their political overseers, including Prime Minister Abhisit Vejjajiva and his deputy Suthep Thuagsuban, as defendants for abuse of power to frame PAD-linked suspects, including Foreign Minister Kasit Piromya.

The lower court ruled that the investigative team, led by assistant national police chief Lt General Wuth Puawet, had acted within the vested mandate and followed the Criminal Procedural Code in filing the charges.

I can't believe Ferwert's outrageous posts! He honestly thinks that the reds are pro democracy? In most democracies if you are convicted of a crime you go to jail. The reds want a convicted criminal to return to power. Is that democrtic? The reds, you say, are not violent? Where were you last Songkran? Come on. The PADs are also well out of order, with the airport seizure, but that does not mean that the reds have ANY moral highgrond here.

Dont forget Thaksin's human rights record. A few thousand dead makes him the worst human rights abuser Thailand has seen in decades. Not exactly democratic either. Make you right about PAD too.

The problem with the grenade launchers and the weapons was one of PAD participants not knowing how to operate them, in-spite of their military training. To throw an illogical charge against the pro-democracy red shirts like that shows total lack of honesty on this board.

Well I completely disagree with your warped views. So let's just leave it at that. But no, I was not referring to warped coup. I was refering to the Courts of this land (which, allow me to remind you, found Thaksin guilty while his puppet government was in power).
