We have approx 20 thai staff and 7 work permits

Depending whether we speak to the lawyer or the accountant we are told that we need varying numbers of Thai staff to match the number of work permits.

I had been informed that the ratio of 4 Thai staff to 1 work permit was pertinent only when the non immigrant b was extended and that is the work permit holders were all on multiple non imm b visas that were not extended and were doing 90 day visa runs this 4 : 1 ratio was not required.

Can someone please point me to an official document in Thai (or a translated one into english) that details what the actual require of is for companies that do not have anyone on an extended visa?

I have surfed around but failed to find what i need.

must be one of those hard to pin down "rules" that are implemented or not as the official on the day see's fit

I believe there is no official rule about this and it depends on the province, ie the local employment department, where the application is made.

The standard answer seems to be 4:1, the Local Labour departments seem to have their own policies on this as Maestro states, if the Company is under BOI privilege then it is possible that the ratio is lower.

Work permit and visa extension are separate matters.

The former is governed by the Ministry of Labour while the latter is with the Immigration Bureau.

Hence if you meet the 3 Million paid up capital per 1 work permit required and your staff is always traveling, there's no need to convert the visa into the yearly "Visa Extension", therefore no need to maintain 4:1 ratio (if you are a company limited). The ratio for branch and rep is 1:1

however, this is a catch 22 situation since if you don't extend your visa, your initial non B visa (if it's single entry) will expire within 90 days and subsequent trips to Thailand will normally use a "Visa on Arrival" which automatically grants you 30 days (depending on your nationality). VoA is not allowed for employment purposes in Thailand but you are holding a valid work permit and coming to work in Thailand!!!!

for the following year's work permit renewal/extension, you will need a new non B immigrant visa and possibly show proof of tax paid in Thailand.
