my one year non-o-visa based on marriage expires on 23rd October,2009 ! When is the latest date I need to apply for a new one ?

Is your permission to stay based on a visa (issued by embassy/consulate abroad) or on extention of stay (issued by Thai immigration)?

on extention of stay issued by Thai immigration Bangkok !

You can apply for a new extension of stay based on marriage (it is not a visa) assuming you meet the requirements (400k in Thai bank for 2 months or 40k/month income) during the last 30 days of your permission to stay. So you should start the process now to allow time if immigration ask you for additional papers.
