How Long Before I Can Divorce If Cant Find Wife?

Hi my wife has vanished and i guess i will never see her again we married in thailand.

Does anyone know how long it is before i can get a divorce on my own due to no contact???

in the uk but i think wife back in thailand with another fella i am not getting the divorce after all what she did i will just let her do it whenever she can. she now has no visa for uk so will need to apply again with new guy. No point me making things eaiser for her she did nothing for me

Married in Thailand but she was able to lve with you in the UK, doesn't make a whole lot of sense that she has returned to Thailand since it seems that getting to the UK may have been an objective in the first place, don't know.

Maybe best to make sure that HMRC knows of your problems since that will make sure that visa problems follow - can you explain which UK visa she has/had?

If an ILR visa, you may want to think about seeing a Solicitor.

I would talk to a lawyer quickly. Is the marriage registered at the embassy or in UK?

I divorced my thia wife just 2 years ago. She tries so hard to get the marriage registered with embassy so she could use canadian divorce laws and get good settlement.

I had my lawyer apply for divorce and he informed me after that the wife made counter claims for divorce. My lawyer informed me it was good I applied first for the judge threwout her counter and I was informed if her papers had gone through first it would have been big problems for me.She made some very wild claims about our relationship.

So talk to a lawyer protect yourself.

My divorce lawyer cost me 25,000 baht and we never made it to court she signed everything the day before court date. Thia divorce courts are usually avoided by thai women. They ask questions you would not believe about your sex life everything.

we married in thailand a few years ago never registered here just in thailand. she had a settlement visa with 6 months until ILR would be granted.

When i first found out about what she was upto i said if you want to be with him go back to thailand and get him to do a visa for you again i am not lying on visa application if we are not together.

I think she has gone back to thailand now with him and will proberly try to get another visa i expect a call soon asking if i will go and get divorced so she can try again. If i say no just wondering how long before she can file for divorce on her own.

Also what would the embassys view be on one visa cancelled and applying for new fiance or spouse visa if i do get divorced so soon

She may still be in england overstaying her visa as she knows its been cancelled

You've already answered the question - her Settlement visa has been canceled therefore I would think it highly unlikely that she will be granted a second one with a different person. If she is on overstay then her position becomes even worse.

Don't know about Canadian laws, but registering it at the Brit embassy doesn't make a whole lot of difference.

If it is registered at the Amphur, then it is recognised in the UK.

Good, if proven is an offence and can lead her to 10 year default on entry to the UK

It wont exactly be cancelled as yet, I presume she hasn't come to the attention of immigration, only the reasons for its issue have changed and so is no longer valid and as such a further extension on its merits will not be issued.

However, as for the other question regarding her next visa, it will based on the 'balance of probabilities', of that particular request, although obviously as one partnership has failed so soon, it may be viewed with a little caution. A further however, if she had managed to reach the UK and this was her sole purpose, all allegedly of course, then they could see it as admirable that she jumped from an unworkable situation.

How does she know it has been cancelled? Do you know it has been cancelled, have you seen evidence? I think it unlikely they would pursue a cancellation, if there was limited time left on the visa, they would just let it run its course.
