Hi,

I got a non imm 'o' 3 months ago in Kuala Lumpur - they of course gave me the initial 3 months and I have to apply to turn it into a one year visa at Chiang mai immigration - I got it based on the fact that my wife teaches here and my kids go to school here.

I was due to go and get it extended yesterday but my wife's school haven't got the paperwork prepared as the person who does that is away - so it looks like it will be next Tuesday before I can go to immigration and apply for the full year.

To cut a long story short - I need to know if I get 7 days grace on making the application - or whether I should be panicking at all - and if I don't have the 7 days up my sleeve - what are the consequences of being late turning up ?

When does your visa expire?

You could always get a 60 day extension on the basis of "visiting Thai wife". 1900 baht. This will give you plenty of breathing space if the paperwork still isn't ready when you hope. The 60 day extension is a one time only situation thought. You can't ever use it again to extend (unless of course you get a new visa at some point in the future)

There is no such thing as a 'grace' period on a visa entry. They may allow you to stay another 7 days with an application for extension of stay but that is normally declined and you have to leave at the end of that time (if you have not done so before). You do not say what your extension of stay will be based on. Does you wife has a one year extension of stay that you will come under? Do you plan to use child education with money in bank account?

What is important is your permitted to stay until date so you should talk with immigration before that ends. It may require you exit to obtain a new visa; or they may be able help you do without.

the last non o I got, they initially gave me 3 months and then after that 3 months I went back and they extended it for another 9 months - they effectively turn it into a one year visa - and it's basically a one year visa when you get it - it's just that you have to turn up after the first three months to get it extended - (or 'turned into') - a one year non o visa -

No as that does not happen - you must extend your stay for a specific reason and pay 1,900 baht fee using a TM.7 form. If you are not using money in a bank account/child education you must be using the fact your wife has a one year extension of stay and riding on that. As you already did one time your passport stamps should indicate what your extension was.

From your last post it does not even seem you are talking about a visa entry. Did you obtain these three months from Immigration or from a visa obtained at a Consulate and entry into Thailand for a 90 day stamp? Need as much detail as you can provide.

sorry I'm being a bit vague about this I know - I'll take it from the top:

I went to KL, got a three month non imm 'o' via paperwork from the school my wife works for - I also took her work permit etc: - that non 'o' visa expired on 20th of this month - yesterday - I now have to re-apply - with all the same paperwork I used in KL - (but updated stuff, as in the school's bona fides etc:) - and I can't get the required documentation from the school until probably next Tuesday, so basically my visa has expired and I am going to be late when I turn up to re-apply.

With past non o's they have given me another 9 months when I've re-applied after the first three months - and when all of us have done our three monthly reports we have always had 7 days up our sleeves - we have always been able to be a few days late and that's never been a problem - I just need to know if I have that bit of extra time in this case.

The 90 day reports are plus/minus 7 days - not visas or extensions of stay.

The visa date is not important - but if your permitted to stay stamp on entry said 20 October you are now on overstay and will be fined 500 baht per day until you leave the country. They 'may' make exception (to allow extension of stay) but it will be luck more than policy. Next week will at the best cost you 3,500 baht overstay plus 1,900 baht extension of stay. It may require a trip out of country. It could result in your arrest by local police (unlikely but has happed with less than 7 days overstay).

You are aware that extensions of stay can be done up to 30 days early? And should be done at least two weeks early?

What you seem to be obtaining is a one year stay based on your wife having a one year extension of stay for employment. There is also a provision for children but that requires a bank deposit which you have not mentioned so unlikely to be for that reason.

Have you ever heard of anybody being allowed an extension of stay on an expired visa/extension Lopburi? Genuine question.

Sorry to stray of topic but in what sort of situation would immi show their caring side and allow this to happen? Somebody involved in an accident and couldn't get there due to being in hospital or the like?

so just to be sure...it may be possible to be granted a 7 day extension on my visa if it is two days or more out of date and then be allowed to submit my papers for the year extension on the same day? I am hoping to take everything with me tomorrow to immigration.

and if this is not the case, presumably i will get to the immigration office they will fine me and then tell me to leave the country and start again?
