Hi Guys,

I have a member of staff who is German. He has a multi-entry non immigrant B visa issued 18/06/09 expiring 17/06/10. He entered Thailand on 31/07/09 and has permission to stay until 28/10/09 (Tomorrow). He has a work permit issued 18th August this year.

My dumb HR department have told him all he needs to do is go to immigration and get stamped for another 90 days, which I know is not possible in his situation.

My question is, is it to late for him to apply for an extension based on his work permit? - I seem to remember reading you should do this at least 3 weeks before your current permission to stay expires? Also can you even apply for an extension if you have 8 months remaining on a multi-entry non-B?

My opinion is that his only option is to do a border run today or tomorrow, then apply for his extension in a couple of months time, but would like confirmation please from the gurus out there please.

PS the last employee who left got stung with 13,000 baht overstay because HR told him he could stay until his visa expires, they really aren't the sharpest knives in the drawer :)

You can try to get an extension today of all paperwork is in order and at hand. otherwise advice him to do a border run for a new 90 days. Given the paperwork involved the last might be better, as he has little time to do all today.

He either has to cross border and return or obtain an extension of stay if he qualifies - there is no 21 day restriction on application when you have a non immigrant visa entry (but it helps to avoid not having the required paperwork). Unless you are sure he/company can support extension of stay the border run may be the best current option.

Thanks Mario, so you can still apply this late in the day?

Do you know what paperwork is required or have a link? I have only started working here this year and am on a multi-entry also (and want to keep it that way as long as possible) so haven't experienced the application process.
