Work Permit And Others

Featured Replies

I AM A FRENCH CITIZEN, UNDER A VALID TOURIST VISA, DID SET UP A COMPANY LIMITED, WITH A THAI PARTNER ...

I MANAGE TO OPEN A BANK ACCOUNT UNDER MY NAME ...

FOR THE COMPANY, WE NEED A BOAT, CAN I BUY THE BOAT, UNDER MY NAME, FOR OBVIOUS SECURITY REASON ...

OR DO WE HAVE TO TRANSFER THE MONEY, ON OUR NEW COMPANY BANK ACCOUNT, AND THEN BUY THE BOAT ...I WOULD OBVIOUSLY, PREFER THE BOAT ITSELF, STAY UNDER MY NAME, SINCE I AM PAYING FOR IT ...

IF POSSIBLE TO KEEP BOAT UNDER MY NAME, CAN I REGISTER IT TOO ..IF YES THEN WHAT AM I SUPPOSE TO DO ...

DO I NEED A WORK PERMIT TO REGISTER THE BOAT ...

CAN I GET THAT WORK PERMIT, WITH THE COMPANY WE JUST SETTLED ..

SORRY THAT'S A LOT OF QUESTIONS

THANKS IF YOU HAVE ANSWERS

PATRICK

Firstly, please do not post in all capital letters. This is considered shouting!

Then to your post:

Bit of a difficult question.

Are you going to use the boat for pleasure, or are you going to use it in the business?

If purely for pleasure, yes you can register it your own name.

If you want to carry passengers, you'll have to put it in company name AND the company will need at least 70% Thai shareholders, with you only holding 30%.

If you register the boat in your own name, you do not need a work permit.you

If you register the boat in the name of the company, then the director of the company need to sign the papers. If you are the director of the company, and wish to sign paperwork while inside Thailand, then yes, you'd need to apply for a work permit and receive it, before you can legally sign any paperwork.

If the company has 4 Thai employees, then you can apply for a work permit. You can apply while here on a tourist visa, but once the labor department has accepted your application (for which you will receive proper paperwork, including the needed form WP3) you will have to leave the country and use the paperwork to apply for a non immigrant B visa.

Only after you return with the non immigrant visa will the labor department issue you with the work permit.

You can get a Thai skipper license for a personally registered boat (again, non commercial use), no work permit needed. For a company registered boat (Thai registration), you will not be allowed to skipper it as a foreigner.

Please, don't use post in capslock. It is considered shouting and unpolite.

As for your question, to own a company you don't need a work permit. Neither to invest into the company, like when buying a boat. If you work in the company, you will need a work permit.

I suppose it is possible to register the boat in your name and lend it to the company. For that kind of thing i would seek competant legal advise.

If you can get a work permit depends on the company and how much is invested and how much staff there is. Hev a look in this htread, which gives you some inforamtion and links: http://www.thaivisa.com/forum/Working-3-4-...tr-t313230.html
