Hi all what is needed for a family visit visa for the uk been married over 4 years and have a baby girl of 2 months.

Plan to return in June next year wife had a settlement visa which runs out in April 2010 we moved too Thailand oct 2008 and dont plan to live in the UK anymore could this be a problem?

Take your pick from the following list, if you're staying with any of them you can apply for a family visit visa:-

"Under the Immigration Appeals (Family Visitor) Regulations 2003, a family visitor is defined as:

1. the applicant's spouse, father, mother, son, daughter, grandfather, grandmother, grandson, granddaughter, brother, sister, uncle, aunt, nephew, niece or first cousin (NB: "first cousin" means, in relation to a person, the son or daughter of his uncle or aunt);

2.the father, mother, brother or sister of the applicant's spouse;

3.the spouse of the applicant's son or daughter;

4.the applicant's stepfather, stepmother, stepson, stepdaughter, stepbrother or stepsister; or

5.a person with whom the applicant has lived as a member of an unmarried couple for at least two of the three years before the day on which his application for entry clearance was made."

As best I understand your plans you hope to travel soon, returning to Thailand in June, after your wife's spouse conditions have expired. There should be no problem applying for a visit visa, it's the proper thing to do if you have no plans to pursue settlement in the UK.

Basically you need to show that you and, especially she, will return to Thailand after the visit. The UKVAC website has a list of suggested supporting documents for the Spouse/Partner of British Citizen (Based in Thailand) going to the UK for a visit (family visit).

I imagine that everything should be pretty straightforward, but, to avoid questions, I would enclose a brief note to explain why she is not using her settlement visa as you have above.
