Can I please ask the Forum's help with the following :

My son attends an international school here in Bangkok. In January this year he was given a One Year Visa, valid until this coming January.

However, I have made the mistake of taking him on an overseas trip with me, without having first arranged a Re-Entry Permit.

So, my question(s) are :

- is the original Visa now null and void? When we re-entered Thailand earlier this week, he was given just a 30 day Tourist Visa

- or, can I go to the Immigration Dept and somehow resurrect the original Visa (the one valid till this coming January)?

- what if I simply do not bother about him having a Visa for a while? (I understand - correct me if I am wrong) that no overstay penalty is

levied on children)?

- or, should I just start the whole long process from scratch again and obtain a new Visa for him?

All replies and advice would be much appreciated.

He evidently had a one year extension of stay for education and on return did not have a re-entry permit so was provided a 30 day visa exempt entry. I suspect the school may require students be on valid entry so believe you should check on that before using the no charge for children on overstay - it is still overstay and so recorded.

If more than a week or two remain on the 30 day entry you can likely change status and make extension of stay without leaving the country with a quick visit to Immigration. Cost would be 2,000 plus 1,900 baht. As insurance you might consider getting a re-entry permit (after extension approved) for 1,000 baht.

Original Visa has been cancelled due to the fact you left Thailand.

You have not indicated how old the child is, therefore it is inappropriate to say no fine for children. The age I believe is under 14 years.

Also I believe that a child requires the correct Visa to attend school, but as the school do not really know the

rules regarding visas they will assume your son is still on a Non Imm type.

Go to immigration with the correct documentation and get a new Non Immigrant Extension, also remember the Reentry Permit in future.

Actually you will need to start from scratch again. This time if you plan on taking him out of the country again maybe pay the 5000 THB and get a Multiple entry visa. I would reccoment starting from scratch a.s.a.p and I'm sure he will be ok. Can always apply for the 7 day extension if they are not ready yet at the end of his 30 day stamp. Also this 30 stamp he has now is NOT a visa, it is just a 30 entery stamp. Many people confuse this with a 30 day Visa.

There is no reason to go outside Thailand to obtain a multi non immigrant O visa as that requires he travel out of the country every 90 days and he easily qualifies for extension of stay.

If you are talking about a multi re-entry permit the cost is 3,800 baht not 5,000.

Correct but I did not say leave the country to obtain this. What I said was he needs tio start from scratch now for his son's "ED" Visa, this is not a non "O" visa.

I mean when he applies fore the ED Visa he should ask for the Multiple Entry Visa stamp and yes your correct its not 5000 THB

rIGHT NOW HE DOES NOT QUALIFY FOR AN EXTENSION OF STAY. aS OF NOW HE ONLY QUALIFIES TO BE IN tHAILAND AS A GUEST FOR 30 DAYS. oops caps were on and I'm to lazy to re-type.

Sorry mod but I just saw this on TV and it clearly states that with a Multi entry visa you must still travel outside the country every 90 days. If your sure I'm wrong could you please enlighten me as I like to keep up on these issues;

Your best choice is to obtain a multiple entry Non-Immigrant visa which valid for 12 months. With this visa type you will need to exit and enter Thailand at least every 90 days to get a new entry stamp allowing you to stay a further 90 days.

If you utilize your visa the last time just before it expires, you will get an extra 3 months "bonus", so the total validity will be nearly 15 months.

You obtain an extension of stay from immigration inside Thailand. You need a non immigrant entry to do so. This entry can be issued by immigration for 2,000 baht if you meet extension of stay requirements and have sufficient time remaining on your current permitted to stay stamp. There is no need to exit country using this method. You would have the option to exit country and obtain a single entry non immigrant visa if you wish and extend from that. A multi entry might also be issued outside Thailand but would require travel every 90 days for a new 90 day entry so not ideal for most people.
