My family and I just moved to Thailand 3 weeks ago. We had a job lined up and a company who provided all the paperwork needed to get a 1 year Single Entry Business Visa.

I found out today that the company didn't know it would have to raise its working capital to employ another foreigner, so it can't get a Work Permit for us.

My question is this: Can I just report every 90 days without a WP or does this mean I have to leave the country every 90 days? I work freelance and have income stremas from other companies, so we would be fine without a Thai income.

Can anyone help? Thanks in advance!

You can not stay longer than 90 days without exit of the country as you will not qualify for extension of stay. And FYI any freelance work would also require a work permit if done in Thailand.

How can you get a 1 year SINGLE entry visa? Only a multiple entry visa would be valid for one year, which would give you almost 15 months of stay with border crossings every 90 days.

But there are certain non-B visas that would give 1 year instead of the usual 90 days. See:

2.2 Non-Immigrant Visa category “B-A” (Business Approved Visa) The granting of such visa to qualified applicants is under the jurisdiction of the Office of the Immigration Bureau in Bangkok. The applicant’s associated company in which he or she will invest in or conduct business with may apply for this type of visa on behalf of the applicant at the Office of the Immigration Bureau. Once the application is approved, the Immigration Bureau will advise the concerned Royal Thai Embassy or Royal Consulate-General via the Ministry of Foreign Affairs to issue the visa to the applicant. The holder of this category “B-A” visa will be permitted to stay for a period of one year from the date of first entry into the Kingdom.

how would someone get a WP for freelance work that's done for companies outside of Thailand?? Is that possible?

Visa just says Non-Imm B. Does that mean that even with a WP I'd have to leave or just check in or get an extension every 90 days??

Hi all,

I would like to ask a question a bit related and I don't want to open a new topic just for this.

I am in an interesting situation. I am in Thaialand at the moment on a tourist visa spending time with my girlfriend (she is thai she used to live in UK 6 years we are together since 4). During the time one friend of mine offered me job, he has an international business and now he about to create a new company here with a Thai partner company. He want me to represent his interests and he willing to provide me all the documents for a Business Visa or the Work Permit from the new company where he will partially own. So my question is can I apply for the WP abroad (I will go to see my family soon in EU) or I have to come back and apply here? Just because the section about WP mention "apply for the WP you must have non immigrant visa" . So the other question is when I return to TH what kind of visa I have to have? Does it has to be Business visa and after apply for a WP?

You would need to set up a Thai company and sell your sevices to the companies outside Thailand

You apply for work permit inside Thailand and you can be on any visa but for issue you must have a non immigrant visa that Labor Office will allow. So you can come on a tourist visa, apply for work permit and take receipt/paperwork to a Consulate nearby to obtain the required non immigrant visa.

So, it's much easier if I will return on a non-immigrant business visa and in this way I could avoid more running around for the paperwork.. right?

Does it say multiple or single and look at the date, the stamp you got at the airport, which tells you till when you are allowed to stay in Thailand. That is the date you need to leave Thailand.
