Hi,

Ok so the wife will soon have been here for 2 years on her spouse settlement visa (Thanks to Thai visa express ) so i need to start putting something together for the ILR, Can someone please advise what i will need? I have been saving all the bank statements, Council tax, utility bills (only gas & water) that has both our names on, Although the first 6 months she was here the utility companies woouldn't put her name on the bill for some stupid reason (water company still wont do it lol) so i will only have 1.5 years worth.

Which form do we need to fill out and what other paper work do they require from us?

When is the soonest she can apply for it? It says she needs to have been here for 2 years so is it best to wait until 2 years has past or to apply before the 2 years, Say 3-4 weeks before her spouse settlement visa runs out? I would persume if she waited until it past then she would get in trouble for being here without a visa correct?

Officially the earliest she can apply is the 2nd anniversary of her arrival with her settlement visa. However, she can submit the application up to 28 days before this date.

She must be in possession of a valid entry clearance or leave to remain when she submits her application. So if her spouse visa expires before she can submit her ILR application she will need to apply (and pay) for further leave to remain to cover the gap. Hopefully this wont be necessary.

Once she has submitted the application her current entry clearance or leave to remain will be automatically extended until the ILR decision has been made.

What tests does she need to pass? I have just seen there is a new english test from december onwards that she must pass? Is there any other test / certs she needs too????? She did her life in uk test nearly 2 years ago now.

The new test applies to applicants for an initial visa to enter the UK as the spouse, fiance or partner. Your wife is already in the UK and this test wont apply to her.

The only language requirement for ILR is the LitUK test (or equivalent course) which you say your wife has already passed.

The government site is very misleading as it says this on the site:

"From 29 November 2010, any migrant who wants to enter or remain in the UK as the partner of a British citizen or a person settled here will need to show that they can speak and understand English"

As she is already here the statement above would still include her as she wants to remain here
