dansan
Is there any guidance on the time it will take to now process the appeals as they are being sent back to the UK? Just had my wifes settlement refused but have been allowed to appeal. Could do with a ball park figure on how long it normally takes.
VisasPlus
Is there any guidance on the time it will take to now process the appeals as they are being sent back to the UK? Just had my wifes settlement refused but have been allowed to appeal. Could do with a ball park figure on how long it normally takes. It will depend on when the refusal decision was made. If the decision was made before last Monday ( 19th December ), and you submit an appeal at the Embassy in Bangkok, then it will be dealt with under the old system. This means that there will be an ECM review of the refusal before a decision is made on whether to reverse the refusal, or whether to allow it to go to appeal in the UK. The Embassy has about 12 weeks to carry out an ECM review ( although they hope to do it quicker ), and if it is decided to allow the decision to go to appeal in the UK the whole process can take several months. If the refusal decision was made on, or after, last Monday, 19th December, then it will be treated under the new rules. This means that you wil have to submit the appeal in the UK ( you can no longer submit in Thailand ), and pay a fee of 80 GBP or 140 GBP, depending on what type of appeal you want. Once the notification of appeal is received in the UK ( and your fee cleared by the bank ) it will then be sent to the visa section at the Embassy in Bangkok, and then an ECM review will be carried out. Nobody, at this time, knows how long all of this will take as this new procedure only came into effect this week. By the way, all appeals are heard in the UK, under the old system and the new system. There is a separate thread on the new appeals charging system. This is the link http://www.thaivisa....-visa-refusals/ If you want advice on the refusal itself, then you can post the refusal notice ( GV51) here, after removing identifying details, and we can perhaps give advice. There is a lot of experience in the forum. Edited December 22, 2011 by VisasPlus

ThaiVisaExpress
This could actually be a lot better the Embassy make some shocking decisions a recent example : A client had been to the UK on a visit visa she spent only 1 month out of 6 weeks in the UK She then went on to marry her partner & they had a child a UK passport holder Assets & Ties 6 Rai of land a house & a car Her husband worked off-shore and spent the majority of the time in Thailand Refused on the grounds you are unemployed with little or no assets & ties which encourage your presence in your host country. What an absolute joke the eco failed to even notice her previous visit visa & missed all the other documents. We appealed the decision & within 3 days they was on the phone asking us to withdraw the appeal immediately. Amazing how they are quick to get in touch when they have made a totally ridiculous decision, yet we have to wait up to 20 working days to get an answer to an email enquiry. Good point Tony on the ECM reviews they are now up to date about time may I add. Edited December 23, 2011 by ThaiVisaExpress
