Hi all

Sorry if this has been discussed before, I couldn't find anything with a quick search.

Do you happen to know what happens when your employment is terminated but you still have your visa valid for a few months.

Can you stay in the country on that visa and if so, for how long? Or do you have to go to immigration and cancel your visa?

Sorry, but this is not accurate.

If you still have a valid visa and you do not have an extension of stay based upon the employment then you are "OK", If. as is more typical, you have a 1 year extension of stay but also a visa that is not expired you would have to look at how long you have been in the country. Over 90 days, but with a valid visa (say a multi-entry non imm B) you would need to leave the country and return (no 7 day grace period.) If you have a single entry visa, or had not been given an extension of stay (usually 1 year) on a multi entry visa, then you are clear up to your 90 days. Finally, if you have a visa that has expired but an extension of stay that has not. You must leave immediately, or can get a 7 day extension from immigration for 1900 baht.

I am sure Lopburi3 or Litebeer will be around presently to correct any misinformation I may have stated. ---- be aware though that the old practice of giving 7 days free ended quite some time ago.

Sorry I didn't explain well, it's an extension of stay (I think by "visa" you mean the original 3 month visa, right? - that was more than a year ago)

So, if I understand correctly, I have to leave immediately once the WP is terminated? Even if the school doesn't cancel the visa?

Sorry mightyharris, had you said that you have to go to immigration and pay 1900 baht it would have been what you said. In the past they would give a week for free after employment was terminated, that is not the case now. Plus, without the OP's second comment we had no way of knowing his situation enough to be sure so I listed several different possible scenarios that all fit with the limited info given in the first post.

It is not a desire to be pedantic, but a desire to save someone an overstay, and a fine of 3500 baht, and most importantly to try and give detailed information when possible.

The key is end of employment - not work permit related anymore as they do not have to be canceled at many places. After last day of work you must visit immigration to cancel extension of stay and leave or change status or obtain a 7 day extension from that day to pack out and leave.

Could you elaborate on that please? How is the work permit not related to the end of employment? You mean you can stop working and keep your WP?

Also, if I leave the country, why do I have to go to immigration first? Isn't the visa cancelled automatically? (as I don't have a re-entry permit)

The work permit is not returned anymore at some locations but that seems to depend on where. There is no tie to work permit now (it used to be work permit could not exceed visa stay).

The new policy is a requirement to cancel extension of stay at end of work with a letter provided by employer. If you immediately leave and do not return on a re-entry permit it is in effect taken care of and do not believe anyone is having a problem doing that if allowed to exit. But we have at least one report of a person not being allowed to exit until it had been taken care of.
