Hello

I would like my Thai girlfriend to come and live with me in the UK (she would like to too).

From reading other posts this certainly doesn't appear to be a straight forward process so am wondering what would be the best way to go about it?

I have recently arrived back in the UK after living the majority of the last five years in Thailand with my girlfriend.

I am now working in the UK and would like my Thai girlfriend to come over to live if possible.

We have been together for 5 years but are not married.

She has a daughter living in the UK from a previous marriage to an Englishman, she has also visited the UK before albeit a long time ago.

She can speak good English, Thai(obviously) and Chinese(Hakka i think)

She is a Thai chef in Thailand

She wants to actively look for and work in the UK

We are both in our early 40s

I own a house in SW London with no mortgage where we can live

I have a well paid steady job that includes a pension and life assurance. I have 2 other pensions.

Does anyone know what it will entail for her to get a settlement visa for the UK or where i can look for further information?

Any pointers would be very much appreciated

Paul, firstly I would say, from the information you have given, that you'd have a very good chance of succeeding with your settlement visa application.

After 5 years together in Thailand (Similar to me and my wife), I'm guessing you must have plenty of information to prove your relationship. (Photos together, bills, hotel/flight bookings etc).

Your Girlfriend will of course need to pass a UKBA approved English Language test to the level of A1. Again, from what you've told us this shouldn't be a problem. I personally can recommend the EET (English Elementry Test) conducted by language solutions in Bangkok.

Also she will need to have an X-Ray at IOM to show she is clear of TB. More info on that in this link

Once the above are in place, the rest of the paperwork ought to be plain sailing (although still a pain in the arrrse).

You need to provide bank statements (at least 6 months), birth certificate photocopy, old and current passport photocopy and all stamped pages, letter of employment (from boss) 2 years tax papers, proof of any assets you claim to own. (house, savings, shares, car, etc) Photos of house (inside & out) where you plan to live, also bills in your name to that address, and bits like that. Anything that can help your application.

Your girlfriend will need to show current and old passports, photocopies of ID card, birth certificate, House register book, drivers licence (if she has). Savings and/or assets. Any University certificates/degrees all add to the cause.

From what you have posted I, too, can see no reason why she should have any difficulty.

There are two basic criteria for settlement as a partner; that you are in a genuine relationship and you can support and accommodate yourselves in the UK without recourse to public funds. From what you have said, you meet both. Applying as an unmarried partner means she will also need to show that you have both been living together outside the UK in a relationship akin to marriage for at least the last two years, which presumably you can do. Short periods apart, e.g. for work commitments, are allowable; so in your sponsors letter simply say why you returned to the UK before she has.

Thanks for the replies - i'll look into all of this.

You mention my need to write a sponsors letter. Is there an example anywhere of what this should look like?

Simple letter outlining the history of your relationship, and expanding on any answers on the application form you feel may need it. I'd also include a list of supporting documents.

Keep it brief.
