Divorce Court Order With No Certificate!

Featured Replies

Hello to those in the know.

I divorced about 5 months ago in court, after my wife filed. The court order was issued and the court ordered my wife to proceed to the Amphur to register the divorce and pick up the certificate.

I thought all along she had, but I found out a few weeks ago she had not.

Question, is the court order still affective and valid, can it be filed with the Amphur at any time or does it lapse?

Am I effectively still married until it is registered and the certificate issued.

Regards and thanx for your inputs

That are questions for a lawyer. But I think you are still married (or a least can be hold accountable for debts by others) as the divorce is not registered and as far as the outside world is concerned you are married.

Strange situation

I cannot answer your main question - Is court order still valid? - with 100% certainty but I give it at least 90% that it is. Courts don't normally order things that then is up to a private person to do or not to do - the order doesn't disappear if they don't. Make a quick check with a lawyer but I bet it is

In regards to if you're married or not: The amphurs computers and everything in Thailand except the court order paper says that you are so yes, you are still married

If future legal problems were to arise, then court has already ordered and that stands from a legal perspective. Meaning that you will be held responsible for debt your wife accumulate but if you take this to court, then you will be freed from responsibility
