Hello.

My friend has recently split up with his wife and has many regrets that the relationship has not worked out but now his wife is living back in Thailand with the children. He is fully supporting his children but feels that he let his children go too easily.

The children have dual nationality, 2 passports and he wishes to bring them back to the uk and take care of them himself. Should she not agree is there any way he could bring them back by means of either Thai or English law (he is woried that the courts often allow the mother however good or bad she might be to keep the children), also can a father kidnap his own children and fly them to the uk???

He is due to seek legal advice but often there is good advice on here so suggested that I would post on his behalf to get an idea.

Please help my friend by offering good sound advice...thanks...slippery

If there is not yet any custody order imposed by any courts either in the UK or in Thailand, then the father is legally entitled to grab back his kids and return with them to the UK.

Once the children are back in the UK with the father, it then becomes the mother’s problem to take legal action against the father for custody of the children.

The Thai court has no jurisdiction in the UK over custody and vice versa.

Taking any sort of civil legal action in Thailand is expensive and could take years, so I doubt whether the mother will take that route. Also considering that the mother still wants your friend’s money each month, it is doubtful that she will do a disappearing act, unless of course the money stops.

My advice to your friend is: Do not stop sending the money for the present otherwise the wife will disappear with the children, plus take action now while the iron is hot and somehow get the kids back to the UK, that is of course if the father has suitable accommodation and is able to care for the children while maybe having to work and earn a living.

Pointless trying to go through the Thai legal system to get custody of the kids. The law will favor the mother even if she has no means of income and no way to support the kids.

Go up country and see how many mixed kids are attending local Thai schools, sons & daughters of mothers that have come out a relationship with farang. It's hard for them, they get ridiculed by society coz they all know what mum was / is....

My advice, come to Thailand, see the kids and leave back to UK with them, as said once they are there is becomes mothers job to get them back, without money and contacts this is almost impossible!
