Who Knows What The Divorce Award Collection Time Limit Is?

I've searched the forums for an answer to this question, but did not find it.

I won a divorce in Thai family court, because my ex got pregnant with a Thai boyfriend while she was still married to me. Is it true that I have 10 years to collect the monetary award for which the court gave me a judgement? I may need to find an asset in her name and foreclose on it. Is there an easier way to collect?

I believe she works for one of her family's businesses. I doubt if I can garnish her wages, because the family will probably deny that she works there and will protect her. As a little background, her family is very wealthy and her dad was a Thai member of parliament.

Not me i would try to get some money out of it if only for the satisfaction. Else there is no consequence for them. But it might be real hard to get money as they are probably smart enough to keep the money away from her name.

I understand the need for spite. I just wont put any effort into it.

If you had competent legal advice they would have told you to be ready to move on any assets in her name immediately after the hearing. Forget about ten years, you would be lucky if she had anything in her name ten DAYS after the hearing. You don't mention how long ago the judgement was made ... anyway meet with a good lawyer this week and see if there is anything left to be salvaged.

In some cases enforcing legal claims imposed by the court should be begun within a year, 5 years or 10 years depending on the situation.

Visit a good bookshop, they have an abundance of reasonably priced Thai civil and criminal acts law books, both in English and in Thai, which should be your first port of call. Could save you a truckload of cash with lawyer's fees.

Next: if you suspect your ex wife has hidden assets stacked away somewhere, the burden lies on you to prove it as this is a civil and not a criminal case.

Now that you already have a court judgment against her in your favour and if you do discover these assets you could apply to the court for what is called a warrant of execution and have the bailiffs sent in to seize her assets.

Another way is to take her to the civil court for what is known as an oral investigation. (No, nothing like what some of you are thinking). She has to swear an oath in court to tell the truth and state what assets she has. She could be liable to a prison sentence for contempt of court if she gives misinformation or lies.

But this is going to cost you, lawyer's fees and court costs and also could takes years to actually get to court.

Another note: make sure that whatever you are doing in Thailand is strictly above board and as far as the law is concerned, the sun shines out of your backside. That includes, visas, property and business ownerships. Otherwise anything shady could be used against you by your ex wife in a court of law.

To conclude, you have to weigh up the situation and decide if pursuing your ex wife in this case is worth all the hassle and costs.

I feel for you having been put into this predicament and like me if you believe in natural justice, sooner or later your ex will receive her just desserts and who knows? Perhaps in the end she done you a favor and given you a fresh chance to start again.

Ehhhh...her family is very wealthy, her dad was an MP - and you're involved in a civil case against them and now you're asking for advice on a public Internet forum?

I understand that all this sucks pretty bad - here's another wake up call for you: The Thai boyfriend might even have a schlong bigger than yours, but trying to find out will only make you look like a complete tosser.

Dont hurt yourself more than you have to. Move on.
