Criminal Court acquits Khattiya's aide

The Criminal Court Friday acquitted an aide of slain red-shirt leader Maj Gen Khattiya Sawasdiphol in the case that he was accused of posing a terror threat on YouTube network.

The court acquitted Pornwat Thongthanabool, alias K Thong, 50, on ground that the public prosecutors' evidences were not strong enough to convict him.

Pornwat, a key aide of Khattiya, alias Seh Daeng, was charged in the court on April 21 2010 with violating the Computer Criminal Act and with committing crime against the national security.

He was accused of posing his own clip allegedly recorded during his radio program declaring that red-shirt people would create turbulence in retaliation against the government.

Pornwat was arrested along with Khattiya when Khattiya went to the Crime Suppression Division to file a complaint. At that time Pornwat was wanted on an arrest warrant. CSD officers went to check Khattiya's vehicle and found him waiting inside and arrested him. Khattiya was arrested after police found a gun in his vehicle.

During the trial, Pornwat denied that he had recorded himself making threats against the government and posting the clip on YouTube.

Pornwat argued that the clip was doctored by someone abroad. He said he is a DJ of community radio station and his voice was doctored along with the clip.

The court ruled that the defendant could provide a proof about the date when he recorded his radio program so he could disprove the evidences of the public prosecutors.

Emerging the courtroom smilingly, Pornwat hugged his son and told reporters that he was acquitted because he could provide an alibi. He said the date of the clip was February 26 2010 but he held a radio program on February 27 2010 so the dates were conflicting.

Three paragraphs:

To me it seems the prosecution made a mistake in the accusation. The clip may have been made before and only played during a radio broadcast. Enough doubt and confusing for the court to dismiss the case. All this assuming the English translation reflects the Thai correctly.

A judicial system that works, the ICC will be interested to hear this ;)

Court Hands Hardline Red-shirt 4-Year Jail Sentence

The Criminal Court has sentenced a hardline red-shirt supporter to four years in jail for illegal possession of weapons.

The Criminal Court has handed a four-year sentence and a 1,000 baht fine on Pornwat Thongthanaboon, for illegal possession of several weapons.

Pornwat is widely known as 'K-Thong', a close associate of the late renegade Major-General Khattiya Sawasdipol, also known as 'Seh Dang'.

In January of last year, Pornwat was arrested for possession of ammunition for various types of assault firearms such M-16 rifles.

Pornwat was later arrested in March in the parking lot of the Crime Suppression Division Headquarters in Bangkok, carrying an unregistered pistol.

K-Thong was escorting Seh Dang to the police office to acknowledge criminal charges, when he was searched while waiting in a white van in the parking lot.

However, the sentence was reduced to 2 year imprisonment and a 500-baht fine because Pornwat pleaded guilty to his crimes.

Anyway, for his YouTube bomb threat case... if he's alleging he didn't say the words, did he ever produce what he did say in this video?

Or is he alleging this isn't him... a Fake Thong, as it were.

Terrorism Case against Red-shirt Hardliner Dropped

The Criminal Court dismisses terrorism charges against a close aide of a pro red-shirt army officer, given the evidence against him is conflicting.

The Criminal Count today ruled to dismiss charges against Pornwat Thongsombun, a close aide of the late Major-General Khattiya Sawasdipol, a radical element of the red-shirt group, filed by public prosecutors for alleged violation of the Computer Act and crime against state security.

The charges stemmed from video clips of Pornwat, broadcast through a webcam program, threatening to stage terror attacks at several venues, which the prosecutors suggested was a violation of the laws on national security and terrorism.

The court said the account about the evidence was inaccurate as the prosecutors stated the video clip was broadcast on February 26 last year, but the suspect actually broadcast the clip on February 27.

The court also reasoned that the clip alone was not sufficient as evidence to prove that the suspect had committed those acts he threatened to do.

He got off on a technical error in the prosecution. It sucks, but it is the law as it should be applied.

Similar case from a land far far away and a time too distant to remember. A nineteen year-old buys a new car (paying cash no less!) does some silly hot-rodding in the heart of a city and gets stopped by the police. Charges include Failure to maintain control of a motor vehicle (all 4 wheels left the ground), reckless driving, speeds in excess of 100MHP on a city street, and doing 107 mph in a 35mph zone ..... police arrest and detain said juvenile (delinquent) but bail is paid and in court the case is thrown out on the technicality that the arresting officer wrote down the wrong address where the stop/tickets/arrest was made. That particular "jd" should have lost his license, but instead walked with no tickets on his record.

Why tell that story? The "State" has as much resources as they choose to use in any court battle, while a defendant is usually more limited, thus the "state" is not allowed to make simple mistakes.

The good news ---- the guy has already been found guilty of other charges and I think still has 2 court cases pending (note -- I think*)

Without having more details is sounds like the doctored tape of PM Abhisit, various words really spoken, but in different situations, times. Just like ransom notes constructed from newspaper clippings.

Doesn't the technology exist to prove whether a tape has been doctored or not? I know that photographs can be doctored so an audio tape shouldn't present too many problems.

I share the concern of others about the courts and the 'evidence' laid before them.

Without having more details is sounds like the doctored tape of PM Abhisit, various words really spoken, but in different situations, times. Just like ransom notes constructed from newspaper clippings.

But the video was one piece.

He must know when and where the place it was shot and what he said on this singular occasion.

If he didn't

threaten to blow up Bangkok Bank and the Stock Exchange of Thailand as the words on the video said, what did

he say at the time the video was made then?

Nope this is about the guy convicted and sentenced for the weapons which makes the weapons relevant. It isn't about Libya, but then again nothing in Thailand really is about Libya :)

No not about Libya however I will use the Libya Situation to point out how selective the supporters of murder are when they claim that Thai's have not been murdered by the army.

So I take it that anybody found with weapons in USA automatically are terrorist . I should think that the time & Date of any offence is a very important point in any court. . Video evidence has to be supported with factual evidence & here they couldn't get the date right. So what has the guns got to do with an offence which hasn't got a date

Your points about Libya are duly noted as comparing Apples to Oranges :)

The gun charges are on the same suspect and thus a valid point of discussion. The gun charges did not carry a terrorism charge (they might have had it been assault rifles, grenades etc) which kills your other specious argument about the USA. Apples and Pomegranates this time :) I think the man still has outstanding charges (2) that can put him in jail for longer than his current conviction.

I agree that the prosecution screwed up and the guy should walk in the youtube case.

Ex Khattiya adviser acquitted over 'civil war' clips

The Criminal Court yesterday acquitted Phornwat Thongthanaboon, who had been accused of posting video clips threatening to wage a civil war in Bangkok. The charges were dropped on grounds of insufficient evidence.

Phornwat was close to the late Army adviser Khattiya Sawasdipol. He admitted to hosting proredshirt radio talks but denied posting any videos with provocative content on the Internet, as alleged in the public prosecutor's indictment. His defence was supported in crossexamination, when his lawyers showed to the court that Phornwat was not on the air on February 27, the day the clips were recorded.

Phornwat, indicted for inciting violence or unrest, also testified that the videos had been doctored by certain foreigners living overseas and called on police to identify these people and arrest them.

Meanwhile, lawyers representing seven core redshirt leaders submitted a petition against a request by the Department of Special Investigation to revoke earlier orders to release them temporarily. The lawyers said the seven people had not violated bail conditions and their speeches during a redshirt really last Saturday did not incite violence or unrest.
