Is your name on his birth certificate as father? Bring his birth certificate and a copy of it plus a photo, and you will get a Non-O. Try to get a multiple entry. Also bring your passport and work permit and copies of these to the consul.

and the document that evidences that you are the lawful guardian. Where will you apply for the visa ?
