The Consumer Protection Board (CPB) is planning to sue the developer of an upscale Bangkok condominium complex for charging home-owners for their air-conditioner shelf.

"As the company neglected to point that fact out to the plaintiffs at the time of contract signing, that's fraud by refraining to tell them the truth and a violation of consumers' rights," PM's Office Minister Ong-art Klampaiboon, who oversees the CPB, said yesterday.

"So the CPB will file a civil lawsuit against Plus Property Co Ltd to demand a refund plus interest for the plaintiff and other customers who suffered the same manner of fee-charging," he said.

Buyers of units in the My Condo Sathorn-Taksin had complained to the CPB that Plus Property levied a monthly maintenance fee based on their condo space including the A/C shelf that extended off the balcony.

The company had refused to give any refunds on grounds that the sales contract included the A/C shelf in calculating a unit's size.

However, since the A/C shelves were actually located outside the building, off the balcony, the area should not be included in the maintenance fee, he said. If the company was decent and had no intention to deceive customers, it should have stated that clearly in the contract since the beginning.

The CPB also agreed to take legal action against three more developers for contract violations.

The agency will demand Bt2.05 million in compensation from Asian Property Development for an injured person over the alleged use of construction materials different from what was listed in the plan for the Ban Klang Krung project.

Khaithat Development Co and Saranya Property 2002 Co will be charged for failing to build and transfer rooms to customers as per the contracts for the Topview Castle and Vista Garden Sukhumvit 71 projects, respectively.

Consumers with problems in buying real estate should file a complaint to the CPB's 1166 hotline, Ong-art said.
