Thai Birth Certificate And Passport

The child was born in the uk to british dad and thai mother, they all moved back to thailand about 2 years ago. the father has since left the mother. The problem is the child only has british passport (on overstay) and british birth certificate. there has been no contact from the father for over 18 month. and no way of getting hold of him. Any idea how to sort the over stay out and get him a thai birth certificate and passport with out the father?

If the child was born in the UK I am sure you have to contact the Thai Embassy in London, who will process a Thai Birth Certificate, this will help you get a Thai Passport. Not sure how difficult without the father. If they were married, when did they get divorced, maybe with the divorce papers she could get the child a passport.

Also a child under a certain age cannot be on overstay.

No overstay payment for child up to the age of 14. The immigration may try it on at the airport but stand your ground.

Immigration will not try it on. There just is no overstay for children under 15.

As said, tthe Thai birt certificate must be obtained from the Thai embassy in the UK, where she can also apply for a passport at the same time. Problem is that the father must also sign for the Thai birth certificate and the Thai passport, unless the parents were not married and they didn't legitimize the child.

Since both mother and child are in Thailand, they can contact the Thai Foreign Ministry, consular section for better advise. It might be possible to apply for the Thai birth certificate (and pasport) through them at the embassy, so no need to travel to the UK.

With the mother named on the birth certificate, it should be possible to obtain extensions of stay for the child. All what is needed is proof of Thai citizenship. The British birth certificate is just that, as it shows who the mother is and if one of the parents is Thai, so is the child.

Sorry I have to disagree. A friend of mine went back home in November 2006 with his kids. All the kids on overstay. They wanted the maximum fine for each child, he had to point out the rules . And it was only after that that they backed down. October/November 2006 was when they had the big change in immigration rules. I don't know when that overstay rule was implemented .

We tried getting the passport office in Thailand to accept a UK birth certificate for a Thai passport application (admittedly over 10 years ago) and they wouldn't. We ended up having to go to the Thai embassy in London as they would issue a Thai birth certificate (and also a Thai passport) based on what was on the UK birth certificate.

As usual, Thai passport for a child required both parents... (Although if you get a letter showing sole responsibility, they'll issue to a single parent... - I think that involves sworn statements to the police...)

I'd have to agree with the earlier post to try the MFA. There must be a way to get the Thai birth certificate and passport issued without doing the return trip to the UK.

The most important thing is, I believe, to get the child onto a house book. Although that probably requires the Thai birth certificate because you need an ID number.

Birth certificates are avaialble by post as far as I remember. It is only the passport where you need to be there in person. Send off to the embassy in London for the BC, apply for the Thai passport in Thailand (after getting the child on the house register...which will require the Thai BC).

Just to let everyone know who added replies, the child has now got his thai birth certificate and we are looking forward to him starting school soon. I Will post a detailed reply on how we managed to do this in the next few days.

First of all we needed to get a copy of his British birth certificate made and stamped at the british embassy, this was done with no trouble considering the british father isn't present. Be aware this cost around 2800baht and you need to have both fathers, mothers and child's passports and birth certificates, copies of the fathers was accepted. you Also the forms handed in before 11am and collection time is between 15.00 16.30, so one full day just for this.

From here you need to have the copy made by the british embassy translated into thai. I got this done for at the next place i needed to go The ministry of foreign affairs (thanon chaeng watthana 304, bangkok) , here you need all stated above plus original tabien baan (blue house book) and divorce documents. They made copy's of everything and sent it off to the thai embassy in England. From here it took around 2 months for his birth certificate to arrive at my house in thailand.

Next step finding him a good school and hope it's as easy renewing his british passport without the father.
