DTAC Faces More Scrutiny Over Foreign Shareholders

The deputy commerce minister has ordered a delay in submitting the preliminary findings regarding the shareholding structure of the country's second-largest cell phone service provider to police, saying more thorough investigation is required.

Deputy Commerce Minister Alongkorn Polbutr said although the Business Development Department has completed its investigation into the shareholding structure of the country's second-largest mobile phone operator, Total Access Communication or DTAC, he has ordered a delay in submitting the investigation results to police to consider its details again.

True Move filed a complaint against DTAC to the Business Development Department, asking the department to initiate a probe into whether its rival breached the Constitution and telecoms law, claiming the majority of its shares is now held by foreigners.

Alongkorn noted that he has set up another working team chaired by his adviser Sanya Sathirabutr to thoroughly examine the report.

He expects the new team to complete the examination within ten days. The results will be forwarded to the commerce minister.

Alongkorn noted that after the final ruling, if it is found that DTAC has breached the Foreign Business Act through the use of nominees, the case will be passed on to the prosecutor and the court.

If the case is still unclear, it will be sent to police to investigate further.

Earlier, Yanyong Puangrat, the permanent secretary of the Commerce Ministry, disclosed that the working team chaired by Business Development Department Director General Banyong Limprayoonwong found evidence that DTAC may be in violation of the country's cap on foreign investment in telecom operators.

At that time, he instructed the department to pass the results of its investigation on to police for further examination.
