Criminal Background Check - Will Investigation Show?

Featured Replies

Hello, if someone is accused of something and investigated by the police, but not formally charged or brought to court because the investigation does not yield anything, is there any record of the incident on one's Thai criminal background check? Thanks for any information.

From Kwaay

No because you havent been convicted of anything

No conviction, NO criminal record..........Rightly or Wromgly you will probally be in their criminal intel system as someone who has been arrested. I wouldnt worry to much about it at all !

All the best

You will find out at the immi. when you come to Thailand next time. :)

It will not show unless you have been arrested or a warrant issued in your name.

Have you been 'away' for seven years ?

I am intrigued to know what your other post was about.

Too good to be true.:D:lol:

I looked but I didn't see it.

You couldn't make this up, could you :clap2::cheesy:

(and, of course, the user name translates as 'dick'.)

No. Most Western Law Enforcement agencies only fill out what is called an "incident report". This is so they have a record of the facts of the detention. This is not a legal paper and usually kept on file locally for a 1 year period. It would not show up on a Criminal background check, at least I know for sure in the US (local, State and Federal) , Uk or Australia.

Maybe not as cut & dried as you might think. If your from the UK for example an "enhanced" disclosure can contain " "relevant and proportional information held on that individual" that is up to the discretion of the police. These rules were bought in after what has become known as the "Soham" murders where two young girls were murdered by the school janitor. He had no criminal record. However he certainly would not have been hired if the school had known he had been questioned by police about offences including rape and criminal assault.

Over and above this is the fact that police from any nation are certainly free to exchange information about an individual to other police forces or immigration agencies if they feel it is in the public interest to do so.

What appears on your background check may be nothing, it doesn't mean to say that information can't be exchanged. Given that your only previous post (so diligently dug up by Semper) related to the age of consent in Thailand I'm probably not the only TV member feeling somewhat uneasy here.

Dear Paulian

Sorry to correct you, in the UK we have a system called "Crimint" the information is graded 1-5, in terms of reliability/credibility 5 being basically hearsay information.

The information can stay on the system for years and years, makes sense really,

ANY officer can access ANY inormation by logging into his computer, If ANY information is aviable he will see it regardless of what the enquiry is,

Cheers

Kwaay - what are you trying to hide?

Hello, thank you for all the feedback. Don't worry, my second post is unrelated to my first post long ago. And I have not been "away". :- ) And I have not done anything wrong or illegal, so please calm down. I've never even gotten a traffic ticket. But particularly living in a small rural village, some people will think the worst of foreigners and start gossiping.

And my nickname does not mean "dick". It means "water buffalo". If it meant dick, it would be "kuay"

Thank you again for your help understanding what a background check is.
