Experienced Advice Required: Time Given To Leave The Country After Termination Of Contract

Hi friends,

I have a question here which requires some kind assistance from you guys.

I would be submitting my letter of resignation (termination of contract) on 1st October 2011. This would be a one month notice, therefore my last day of work here in Thailand would be on 1st November 2011. I understand that I would need to return/surrender my work permit within 7 days from the date of my resignation, that is, from 1st to 7th November 2011.

However, what about my Stay Permit (i.e. VISA)? For how long more can I stay in Thailand after my resignation (i.e. after 1st November 2011)? Currently, my VISA runs till March 2012, the same period as my work permit. Does it mean that I can still stay around here in Thailand for some time even after surrendering my work permit? It seems like the case because I don’t think my VISA date would be altered after I return my work permit, would it?

Hope to hear some useful advice from anyone who has experience with such scenarios before.

If you have a Visa you can stay until it runs out.

If you have an extension of stay (got from Immigration in Thailand) then you have to leave the country when your work finishes, or get a 7day extension with proof of onward travel from Immigration.

As said, it depends on what you have. A visa entry of 90 days doesn't expire. But you appear to have a yearly extension from immigraiton based on work, that does become invalid the day your employement ends.

On that day you have to cancel your work eprmit and permisison to stay with a letter from your employer, clearly stating the day your employment ends. Youc an than get 7 days from immirgation to leave the country, for 1,900 baht or leave the country directly.

However, if you fall under the One Stop Centre, you might get 2 weeks for free.

Thanks for your reply.

However, I am not sure about what you meant.

My current VISA is a one-year extension stay permit (till March 2011), and not the 3-months VISA (temporary VISA while waiting to get the work permit).

Given so, do you really mean I can hang around in Thailand until next year after I resign on 1st November 2011?

Need more clarification on this.

Just 2 more quick questions:

1) Can you explain more about the One Stop Centre? I hope to fall under that category if I know what it is...

2) You mentioned that the employer will issue a letter and both my work permit and stay permit date would be altered to tally with the final day of my employment. Do you mean that I have to bring that letter to the immigration centre to cancel my stay permit, or can i just exit the country without needing to go the immigration centre?

If you got an extension from Immigration in Thailand then you must leave when you finish the job.

The One Stop service is for certain companies, you would have done your extension there and your work permit if your company could have used it, if you did not then you have to use Chaengwattana.

I just resigned from my job at the end of last month, on the last day I was asked to take my work permit to the labour department who then cancelled it and gave me a Tor Tor 10 form stamped to take to immigration. Immigration then cancelled my visa on the spot and said I had to leave the country within 24 hours or I could get a 7 day extension for 1900 Baht. I opted for the 7 days which gave me time to organise my trip out of Thailand to obtain my new visa for my new job.

My visa still had 5 months running on it but this doesn't matter, it still gets cancelled. Also you asked about just holding on to your visa then exiting the country, I know someone that did this and were hammered with overstay on exit as their employer had cancelled the visa at immigration, so not advisable.

I have a better idea now about the procedure.

Unfortunately for me, taking the Tor Tor 10 form to the immigation would be a hassle because I reside in a rural province where the immigration is at a border town. Given so, i have two options:

a) I can choose to go to the Immigration Centre in Bangkok to cancel the visa and leave from Bangkok International Airport thereafter.

B) Another way is the possibility of not bringing the Tor Tor 10 form to the immigration for cancellation of VISA. Is it okie if I just return my work permit to the labour department and exit the country immediately without going to the immigration centre?

Hope any of you can let me know which is the desirable option and whether option 2 is do-able.
