The money has to be in a bank in Thailand for extensions of the visa at immigration, but can be offshore for the original application at an embassy or consulate.

I think you will find that the OP is talking about an extension based on marriage (no a Non-Imm 'O' based on visiting a Thai wife, as inferred by posts #2 and #3).

As TerryLH pointed out it has to be in a Thai bank for visa extension purposes. The deposit needs to 'season' for 2 months.

You don't need any income evidence for the Non-Imm 'O', only marriage certificate.

I assume that you just need a normal NON 'O' visa in your passport before applying for the extension after being married.

When is the best time to apply for the visa extension in regards to your NON 'O'' expiry date, or does it not matter?

Also, what if you oringinally have a NON 'B' does that make any difference?

You need a Non Imm Visa

Apply within the final 30 days of your permision to stay.

(1) The alien has obtained a temporary visa (NON-IM)

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

As said 400,000 Baht in a Thai bank for a period of 2 months before application for a 12 month extension based on having a Thai Wife.

I have a multi entry non o (wife and a bunch of kids) that expired in August. I departed in June. Will return next week. Can I get that visa renewed in Thailand? (I did the 4 visa runs on that visa and the 15 months have come and gone). I won't have 400K in a Thai bank but I can go to my embassy in BKK and get that verification of monthly income letter.

That Visa is dead. What will you have when you return next week?

Here are the rules.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

If you do not have a Non Imm Visa when you return, Immigration will issue one providing you qualify for the 12 month extension.

If you are using a bank deposit for the application, it must be 400000 baht deposited in a Thai bank and "seasoned" for 2 months? (it used to be 3). But why tie up any money? All you need is an Income Affidavit from your Embassy stating what yor income is ( In Thai Baht it must be more that 40000 baht per month) and it must be issued within 1 month prior to your extension. I don't know what the UK EMbassy requires as proof of income, but the US Embassy requires nothing. The first time I did it I scrambled to get all of the proof and when I went in they said that I didn't need anything. I just fill out a form every year and write down the amount that I make every month in dollars, the embasssy collects $50 and notoarizes it, the immigration office converts it to Thai baht and if it's over 40000 baht everythigs okay. I asked why no proof and they said that if the information was not true that Iit was perjury and punishable by a year in prison and a $10000 fine. So I could put any amount that I wanted. if I wanted to risk the penalty.. Just another breaucratic scam. Sorry for the sarcasim but I just "swam" to Bangkok the day before yesterday - 14 hour roundtrip that normally takes 6) - to get one so the I can extend my visa that expires on Tuesday at an office that is flooded!

That's not true at all offices.

I just used one that was 4 months old.

Basically, as you guessed, no your original non o is expired and can't be renewed.

You start the whole process over.

If you have time before you leave go to the nearest Thai consulate and try to get yourself at least a single entry tourist visa.

That will get you 60 days on arrival in Thailand...and give you time to get a new non o visa in Thailand.

Alternatively, Kuala Lampur in Malaysia will issue a 90 day non o visa with proof of marriage (marriage liscense) and proof of only 100K Baht in a Thai Bant account (vice 400K for other countries or Thailand).

Call them to get exact requirements and documents they want to see you provide.

Expect to pay for plane flight, two days in KL...passport must be presented the first day in morning and visa picked up second afternoon...so effectively 2 days hotel required in KL, and flight back.

On arrival back in Thailand you will get 90 day stamp...use that time wisely and in last 30 days apply for your marriage visa (extension of stay based on marriage).

Once you have that extension...90 day reporting required...if you leave Thailand be sure to purchase at least a single exit-reentry permit before you leave. Otherwise, if departing Thailand without that exit-reentry permit you void your extension, and have to do it all again.

That would be a silly thing to do.

Sorry for the misinformation. I was just quoting the regulation as stated on the immigration website and my experience the last four extensions at three offices (Tak, Bangkok & Nakhon Sawan). The final decision rests with the immigration officer that processes the paperwork and his/her interpretation of the regulation. Sorry if I missled anybody, the best thing is to call the office where you are going to have your extension processed and ask what is required and hope that the left hand is talking to the right hand, but don't count on it! I extended in Korat one time and when I called they said that I needed two copies of everything. I went in with two copies, but the recepionist rejected it because there were different pictures attached to the two TM 7 forms. I drove to town and had new pictures taken, went back to the same person who now said everything was okay, was handed over to an immigration officer who reviewed the package and then was told that I only needed one copy and gave me back the other! I've actually had the requirement waived and the extension was processed without any proof of income.
