Cyber crime bill in progress

BANGKOK: -- The government is working on an anti-cyber crime bill which would carry a prospective penalty of five years in prison for possession and online distribution or posting of child pornography and a one-year term for hacking, whip spokesman Wattana Sengpairoh said yesterday.

Other offences included in the bill are the spreading of false information on websites which could cause public panic (five years in prison), superimposing sexual content on the images of real people or altering a person’s image to make it sexually provocative (three years) and producing or posting general pornographic material (five years).

Wattana said a regulation barring children from playing online games at Internet cafes would be included in the bill.

While they are working on this bill, would it be possible for them to define "children". At what age does one cease to be a child? If a teenager is caught playing an online game at an internet cafe, does he/she suddenly revert to childhood and get busted?

we should note, however, that beyond the "silly stupid childish obsession about sex"... there might be a political agenda. "Spreading false information"... could cover bird flu, the delay in building the new airport etc.

Bangkok - In a first test of the controversial new law, Mr. cclub75 was sentenced to 5 years in prison at the infamous Bang Kwang Central Prison today following comments he posted on the thaivisa website.

His attorney promised to appeal to the Surpreme Court as he referred to the 1997 Thai Constitution which gurantees the freedom of speech. Governmental prosecutor Somdet Shinawatra, who cheered the conviction, promised to seek immediate revocation of Mr. cclub75's bail.

"We can not have anyone, particularly foreigners, spreading false information about our respected government employees," he said at a packed news conference.

At the end of the news conference, Mr. cclub75's attorney reiterated comments he made in open court that his client's comments were merely a figure of speech and weren't meant to imply that Khun Watana was a egotistical, out-of-control, power-hungry, psychotic madman. Following this, police arrested Mr. cclub75's attorney and placed him in adjoining cell to his client while they begin his prosecution. Somdet Shinawatra, meanwhile, cheered gleefully at the prospect of taking on another enemy of TRT.... errr... the state.

I feel that the porn bit (except the child pornography that was already and rightly illegal) is just added to take away the attention from the real issue: censorship of unpleasant information regarding the government (read TRT, Shin etc.)
