You will NEVER own that house - unless you are naturalized as a Thai. The house you build will be under your wife's name.

The Land is owned by your wife , that is hers .However, building a house CAN be yours if you build. A lawyer can draw up a contract to say you are building a house on her land and that if in the future things go pear shaped in the relationship ,you can dismantle the house and remove it from her land. The only issue I can see with this is that she does have the power as the owner of the land to refuse you permission to enter her land. When this happens , the lawyer is needed again and can result in going to court. The Judge has in the past granted permission for the house builder to remove his house. Keep all your reciepts from the build and then you have the proof of what monnies you have paid.

If you are worried you could possibly lose all your money from the house build if things dont go to plan, build a very modest house with the least expense , then at least you have somewhere to live and not need to worry if you leave the house as the money you could have spent will be in the bank.

He got a court order done that allows no one to live in the house that he built other than himself , he isnt allowed on to the land other than to remove the house. The house wasnt removed , but no one is living in it as they are not allowed , its just rotting away.

The other option is NOT to build on her land but buy some other land , put it into your name and then build your house. There are ways .

Hi!

The best way you can do it,is let your wife own the house, and then go to a lawyer and make up an Usufruct agreement.

This Usufruct,you make so you have all the rights to the house-and if your wife agree,the land-running until you are dead.

Then NO ONE,can take it from you-it have been proving several times in court here in Thailand.

Might be a better idea to ask a mod to move this to the housing forum. You can't own land yourself but there are ways you can build/own a house on your lady's land although the Usufruct that's been mentioned already might be a better option.

I think the bottom line is trust in the relationship, if you want to live with a woman and don't trust her enough to build her a house then you may need to reconsider.

I know from personal experience that the Land Office in Chiang Saen interpret the law in a slightly different manner than other Land Offices in Thailand seem to do.

So, what you hear from other people's experiences in different parts of Thailand may not be 100% relevant to your case.

Can I ask, whereabouts the land is? Just out of curiosity :)

What do you intend to do with the house? If you're going to live in it then just build what you want and enjoy it. If you're thinking of it as an investment, like a house in a Western country might be, then I would say that it doesn't really seem to work that way in Thailand, especially up in the more remote areas like Chiang Saen.

My in-laws and their neighbours are builders too by the way, so if you need people further down the line let me know.

What about taking a long term lease on the wife's land?

Will that work?

you can get a 20 year lease on land that has no chanot and a re-newable 30 year lease on land that does. You must have within the contract that the land cannot be sold , given away , used in any way what so ever other than to house the the person on the contract for as long as the agreement states.

Yonok? NIce :) Our house is on the other side of Wiang Chiang Saen in Ban Sob Kham

Sounds like you will have a nice arrangement going on, I wish I could be there 6-9 months of the year!

All of this, I think, depends on how stuck on the idea of ownership you are. As a couple of people have said, there are legal safeguards but there are also varying opinions on exactly how 'safe' they are!

If your relationship is strong enough, then there should never be an issue between you as to who actually owns the house. If it does all take on the shape of a pear, then what would you want to do with her house anyway?

That, I suppose, depends on how much money you put into it and how that impacts on your finances.

Our house was cheap, my wife will keep it if she gets bored of me and stops talking to me or wanting to be married to me. I knew that when we bought it!
