I need some help for a friend, a thai woman (44). she is badly treated by her elderly boy-friend (69). but she owns the land and house. the husband just got a 30 yrs lease on the land. can she - with the help of a lawyer - move the friend out of the land and house?

She should just leave and wait a year or two, maybe three.

( Unless it's actual abuse that would warrant prosecution. )

My maths might be a little of but he is 69 years old now. In 30 years time, I dont think he will either know or care about renewing a lease.

Sorry gang, I should have mentioned that I was being facetious in my post.

If she wants to kick him out of his leasehold, shes gonna have to wait 60 years at which time neither of them will probably be here any more.

Was the 30 year lease registered on the Chanote ?? If yes legally have to wait 30 years, second 30 year term not enforceable, although that could very well be a mute point considering his age.

If not registered on Chanote lease is assumed to be a max of 3 years.

For some reason, I cannot stop wondering that while the Thai lady owns the house and land, who paid for the house and land?

I am sure that it is just my suspicious mind that says the farang bought and paid for the lot, and has the only legal option for him (the lease).

If she wants him out, he will be on the outside looking in. Someone forgot to tell him that a 30 year lease between a husband and his wife is all but useless. That is part of the marriage property and she has a share in it.

If husband then the lease can be invalidated by either party, but, property, if acquired after marriage, is jointly owned irrespective of whose name is on the chanote ie sin somros.

In a divorce value is normally split 50-50. However depending on the lawyer the outcome may be different.

Just want to be clear, I was not suggesting husband and wife are joint owners of the land. Only that the VALUE of the asset is shared between both in case of a court authorized sale. Of course trying to get full value from a sale can also be problematic, if not sold in a year it is usually auctioned.

That is my understanding, not a legal position, happy to be corrected by someone more knowledgeable.
